RESOLUTION NO. 628- 1988
A RESOLUTION AUTHORIZING THE COUNTY ATTORNEY
TO EMPLOY JOHN BIGLER AS TEMPORARY ATTORNEY
FOR THE CODE ENFORCEMENT BOARD UNTIL SUCH
TIME AS A PERMANENT ATTORNEY IS SELECTED.
WHEREAS, Monroe County did recently modify the ordinance
regulating the Code Enforcement Board; and
WHEREAS, pursuant to the provisions of that ordinance the
Board of County Commissioners shall select an attorney as an
advisor to the Code Enforcement Board to act as independent
counsel while the office of the County Attorney advises the Code
Enforcement office of Monroe County; and
WHEREAS, the County Attorney's office has withdrawn the
Assistant County Attorney who has formerly advised the Code
Enforcement Board due to a conflict of interest and the require-
ments of F.S. 5162.05; and
WHEREAS, John Bigler has acted as a Hearing Officer on
behalf of Monroe County for the past year in land use vested
rights matters and is otherwise highly qualified to act as an
advisor to the Code Enforcement Board by virtue of his experience
as a legal officer at courts martial and other general legal
experiences; now, therefore
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA that said Board authorizes the County
Attorney to employ John Bigler as the attorney for the Code
Enforcement Board for their meeting of the 29th of November,
1988, and such other meetings as may be held until such time as a
permanent attorney for the Code Enforcement Board is selected by
the Board of County Commissioners and is further authorized to
pay him his customary hourly rate of $125.00 per hour for
services rendered herein.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the 22nd day of November, A.D., 1988.
