RESOLUTION NO. 630 -1988
A RESOLUTION OF THE BOARD OF COUNTY COMMIS-
SIONERS OF MONROE COUNTY, FLORIDA, AUTHORIZ-
ING THE MAYOR/CHAIRMAN OF SAID BOARD TO
EXECUTE AN INTERLOCAL AGREEMENT BY AND
BETWEEN THE CITY OF KEY WEST AND MONROE
COUNTY CONCERNING USE OF CASKET LIFT.
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, as follows:
That the Mayor/Chairman of said Board is hereby authorized
to execute an Interlocal Agreement by and between the City of Key
West and Monroe County, a copy of same being attached hereto,
concerning the use of a casket lift.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held

IN1'ERlOCAL ~
WHEREAS, the City of Key West, Florida (hereinafter referred to as
"CITY") , and Monroe County, Florida (hereinafter referred to as
"COUNTY~, desire to enter into an interlocal agreement by which CITY
will possess and.use for burials, a casket lift that is owned by
COUNIY ,
NOW, THEREFORE, it is hereby mutually agreed between COUNTY and
CITY as follows:
1. CITY will use and maintain a casket lift that is owned by
COUNTY. Said casket lift, while being used by CITY, will be used in
accordance with instructions given by the Sexton for the City Cemetery
in Key West, Florida. At all times the casket lift shall be operated
by one who is experienced in operating a casket lift.
2. CITY shall be responsible for incidental repairs to and
maintenance of the casket lift as long as this Interlocal Agreement is
in effect.
3. CITY does hereby indemnify COUNTY for any and all claims of
any sort whatsoever that arise from the use of the casket lift. In
this respect, CITY agrees to hold harmless and to assume any and all
responsibility for any claims or damages resulting from the use of the
casket lift during the length of time wherein said use of the casket
lift continues. CITY agrees in this regard to defend and pay any and
all costs for said defense to include attorney's fees, costs of Court
and all such expenses relating to said claims, should the same occur.
In the event liability insurance is carried by CITY that provides
coverage for the activities prescribed and shown in- this Agreement,
that COUNTY shall be shown thereon as a co-insured and a copy of said
policy shall be forthwith made available to County Administrator so
reflecting.
This Interlocal Agreement shall take effect when executed by both
parties and shall remain in effect for ~ (~ years from the date
of execution. ~

IN WITNESS WHEREOF, the parties hereto have caused this Agreement
to be executed by their officials thereunto duly authorized.
