Summary of RequestjReport On August 27, 1987, the Board of County Commissioners approved a map change in the first round of amendments for Lot 48 of Mates Beach No.2, from NA to IS. Lots 46 and 47 are immedi- ately adjacent to Lot 48 and of substantially the same character, being upland, scarified lots in a Monroe County approved subdivision known as Mates Beach No.2. MEMORANDUM DATE: November 28, 1988 TO: Monroe County Board of County Commissioners FROM: Donald Craig RE: Boundary Determination for Mates Beach No.2, Lots 46 and 47 ----------------------------------------------------------------- Background: Lots 46 and 47 of Mates Beach No. 2 are currently in a Native Area (NA) land use district. The owners of lots 46 and 47 wish a boundary determination so that a single family residence may be developed on these two lots. The lot adjacent to the west, Lot 48, was changed from NA to IS in the first round of map amendments. Recommendation: Move the IS/NA district boundary to include lots 46 and 47 in the Improved Subdivision (IS) land use district. Alternatives: Allow lots 46 and 47 to remain in the NA district which would require the property owners to purchase TDR's in order to develop a single family home on these scarified upland lots, and would be inconsistent with the purpose of the NA district which is to protect undisturbed, natural areas. Findings of Fact: 1. The designation of the above property as Improved Subdivision (IS) rather than Native Area (NA) will be consistent with the purpose of the Improved Subdi vi sion Di strict, Section 9.5-213, and the uses allowed within that district, Section 9.5-242. 2. The determination was based on the following: These two lots are at the end of a road, with canals on the east and south. The lot immediately adjacent to these lots, Lot 48, was changed from NA to I S in the first round of map amendments. On the zoning maps in effect before the land use plan, Lots 46 and 47 are shown as RU-1. ,f , . ,.,.~ ..,-;;." ~- "f1(j'f :." On the land use maps signed effective September 15, 1986, imprecisely drawn but appears the NA land use district. by Charles Pattison, the NAilS boundary is to include these lots in Lots 46 and 47 are no different from Lot 48, being upland, scarified lots in the same approved subdivision. A biologist from the Environmental Resources Department made a site visit on November 16, 1988, and concluded: "These two lots can properly be changed environmentally from NA to IS as they are upland disturbed lots." 3.
