RESOLUTION DEEMING THE COMPLETION OF THE SR
5/USl FOUR LANING PROJECT IN MARATHON TO BE
AN EMERGENCY MATTER; REAFFIRMING THE PROJECT
PRIORITY AND REQUESTING THE FLORIDA DEPART-
MENT OF TRANSPORTATION TO EXPEDITE COM-
PLETION; REQUESTING THE SOUTH FLORIDA WATER
MANAGEMENT DISTRICT TO ISSUE ITS SURFACE
WATER MANAGEMENT CONSTRUCTION AND OPERATION
PERMIT TO FDOT WITHOUT FURTHER DELAY; DIRECT-
ING THE CLERK TO THE BOARD OF COUNTY COMMIS-
SIONERS TO FORWARD COPIES OF THIS RESOLUTION
TO SFWMD AND FDOT.
WHEREAS, previous Boards of County Commissioners of Monroe
County, Florida, by their actions in passing Resolution
11266-1982, dated October 18, 1982; Resolution 11224-1983, dated
July 22, 1983 and entering into a two-party agreement with the
Florida Department of Transportation (FDOT), dated January 29,
1985, as well as their reaffirmation of all such prior actions at
a special meeting held at Key Colony Beach City Hall on May 9,
1985, have consistently supported the FDOT's efforts to expedite
the completion of the 4-laning of U.S.#1 in the Marathon area;
and
WHEREAS, with regard to the creation of drainage retention
ponds at the east and west ends of the Marathon Airport as a part
of the overall 4-laning project, which concept was endorsed, with
the proviso that a bird hazard to user aircraft not be created,
by the Federal Aviation Administration by letter dated, September
9, 1983, the said prior Boards of County Commissioners have
similarly and on numerous occasions approved such drainage
concept utilizing retention ponds as a necessary component of the
overall 4-laning project; and
WHEREAS, as a result of an administrative hearing conducted
in Marathon by the Division of Administrative Hearings in early
1986, the previous construction permit for Class V Drainage Wells
forming an integral part of the drainage pond design as had been
previously issued to FDOT by the Florida Department of Environ-
mental Regulation (FDER) was revoked; and
WHEREAS, the FDOT has now redesigned the retention pond
overflow system eliminating the wells previously proposed and
substituting in their place a state-of-the-art underdrain sand
filtering system which will improve bleed-down and water quality
and incorporates baffles into the piping system prior to dis-
charge into the retention areas and has submitted permit applica-
tion numbers 032l6-D and 072S6-F, dated September 18, 1986 to the
South Florida Water Management District (SFWMD) for a surface
water management permit; and
WHEREAS, the staff of the SFWMD, in their comprehensive
review of the FDOT permit application and design plans has stated
that the applicant has designed the water management system far
above the minimum criteria required by Chapter 17-3, Florida
Administrative Code (FAC), and has recommended that the SFWMD
Board issue the requested construction and operation permit
subj ect to some IS special conditions which include that the
operation of the surface water management system shall be the
responsibility of the FDOT; and
WHEREAS, in view of the continuing and steadily increasing
traffic loading along US#1 in the Marathon area which has been
particularly manifested during this holiday and peak tourist
season to the extent that this Board of Monroe County Commission-
ers requested, at a special meeting December 29, 1986, that the
Florida Highway Patrol provide additional enforcement personnel
and, if necessary, the Governor be asked to callout the National
Guard to assist in controlling the saturated, gridlock on-going
traffic in Marathon due to construction operations and the lack
of an adequate 4-lane segment throughout the area; and
WHEREAS, it is clearly in the best interest of the health,
safety and welfare of all residents and visitors to Monroe County
that this project not be delayed any longer than it already has;
now therefore
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, that:
Section 1. The Board of Monroe County Commissioners deems
that the completion of the 4-laning project of SR SIUSl in
Marathon to be an emergency matter due to its impact on the
public safety and economic viability of the community.

Section 2.
The Commission reaffirms that the Marathon
4-laning is a priority project of the highest order in Monroe
County and requests that the FDOT move ahead to completion as
expeditiously as possible.
Section 3. The Commission further requests that the SFWMD
issue the necessary surface water management construction and
operation permit without further delay to FDOT in accordance with
the SFWMD staff recommendations to that effect.
Section 4. The Clerk to the Board of County Commissioners
is hereby directed to forward certified copies of this Resolution
to Mr. Vern Kaiser, Administrative Supervisor, South Florida
Water Management District, P. O. Box V, West Palm Beach, Florida
33042 with an informational copy to Mr. John H. Taylor, Deputy
Assistant Secretary, FDOT, District VI, 401 NW 2nd Avenue, Suite
590, Miami, Florida 33128.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board on the
6th day of January, A.D., 1987.
