Y fl { RESOLUTION NO. 381-1994 Planning Department A RESOLUTION DENYING A LAND USE DISTRICT MAP AMENDMENT CHANGING THE LAND USE DESIGNATION FOR THE FLORIDA KEYS ELECTRIC COOPERATIVE ASSOC., INC. PROPERTY LEGALLY DESCRIBED AS LOTS 6 & 7, BLOCK 4, SINGLETON'S ADDITION OF TAVERNIER COVE, KEY LARGO, MONROE COUNTY FLORIDA FROM IMPROVED SUBDIVISION (IS) TO SUBURBAN COMMERCIAL (SC). WHEREAS, Section 9.5-511 (c), Monroe Count v Code of Ordinanc- es (Code), provides that the land development regulations (Chap- ter 9.5 of the Code), including the land use district maps, may be amended or changed at any time; and WHEREAS, the Board of County Commissioners on February 28, 1986, designated Lots 6 and 7, Block 4, Singleton's Addition of Tavernier Cove, Key Largo, Section 34, Township 62S, Range 38E, Real Estate Numbers 00506570-000000 and 00506580-000000, as Im- proved Subdivision (IS), and FKEC1.15A/TXTAMAP Page 1 Initials WHEREAS, the applicant has requested a map amendment for the above described property to change its land use district designa- tion from Improved Subdivision (IS) to Suburban Commercial (SC); and WHEREAS, the Planning Department's staff have reviewed the proposed land use district map changes and recommended approval; and WHEREAS, during the amendment process, the Development Review Committee, after due notice and public participation in the hear- ing process, has reviewed the proposed land use district map changes and recommended approval; and WHEREAS, during the amendment process, the Monroe County Planning Commission, sitting as the local planning agency, after due notice and public participation in the hearing process, has reviewed the proposed land use district map changes, and the recommendations of the Planning Department and the Development Review Committee; and WHEREAS, the Planning Commission made the following Findings of Fact and Conclusions of Law based upon the evidence presented, and found that: FKEC1.15A/TXTAMAP Page 2 Initials 1. No data errors occurred on the 1986 Existing Land Conditions Map for this property; and that 2. The Planning Department and this Commission has provided some documentation demonstrating changed proj ections of facility needs, however, this Commission finds that the information provided does not sustain a finding of changed proj ections; and that 3. The Applicant was unable to demonstrate that they meet the criteria necessary to approve this rezoning; and that 4. The Applicant's arguments that they need a rezoning in order to provide for adequate parking sites for their public facili- ty is not a sufficient justification for the rezoning; and that 5. The proposed rezoning would be inconsistent with the habitat of the area and the neighboring residential uses; WHEREAS, the Planning Commission recommends that the Monroe County Board of Commissioners deny the applicant's request to FKEC1.15A/TXTAMAP Page 3 Initials rezone the property from Improved Subdivision (IS) to Suburban Commercial (SC); and WHEREAS, the Monroe County Board of Commissioners, after due notice and public participation in the hearing process, has re- viewed all of the above recommendations; NOW THEREFORE BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF MONROE COUN- TY, FLORIDA: THAT Section 1. This Board specifically adopts the findings of facts and conclusions of law reached by the Planning Commission as our own; and therefore Section 2. The previously described property, as shown on the attached map, which is hereby incorporated by reference, and attached as exhibit 1, shows that the property is currently desig- nated as Improved Subdivision (IS) and shall remain designated as Improved Subdivision (IS).
