Resolution 348-1986 City of Layton, Florida RESOLUTION NO. 348 -1986 A RESOLUTION OF THE BOARD OF COUNTY COMrlIS- SIONERS OF MONROE COUNTY, FLORIDA, ACTING AS THE BOARD OF GOVERNORS OF THE MUNICIPAL SERVICE DISTRICT OF MONROE COUNTY, FLORIDA, AUTHORIZING THE MAYOR AND CHAIRMAN OF SAID BOARD TO EXECUTE AN INTERLOCAL AGREEMENT BY AND BETWEEN THE CITY OF LAYTON, FLORIDA, AND THE MUNICIPAL SERVICE DISTRICT OF MONROE COUNTY, FLORIDA, CONCERNING THE CITY'S USE OF THE DISTRICT'S BRUSH CHIPPER. BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, ACTING AS THE BOARD OF GOVERNORS OF THE MUNICIPAL SERVICE DISTRICT OF MONROE COUNTY, FLORIDA, as follows: That the Mayor and Chairman of said Board is hereby authorized to execute an Interlocal Agreement by and between the City of Layton, Florida, and the Municipal Service District of Monroe County, Florida, a copy of same being attached hereto, concerning the City's use of the District's brush chipper. PASSED AND ADOPTED by the Board of County Commissioners of Monroe County, Florida, acting as the Board of Governors of the Municipal Service District of Monroe County, Florida, at a regular meeting of said Board held on the /~tJ day of November, 1986. KOLHAGE, Clerk -MLi~'&f', APPROVED AS TO FORM A7DLEGALSU~RCl NC~~ BY - "~ ~*~ INTERLOCAL AGREEMENT WHEREAS, the City of Layton, Florida, hereinafter referred to as "City", and the Municipal Service District of Monroe County, Florida, hereinafter referred to as "County" desire to enter into an Interlocal Agreement in which the City, will have the use of a chipper, that is owned by the County. NOW, THEREFORE, it is hereby mutually agreed between the County, and the City, as follows: 1. The City, shall pay the County, Five Dollars ($5.00) per hour for the use of the chipper. The appropriate City officials will report to the County the number of hours that the City used the chipper. Payment shall be made on the first of each month for the hours the chipper is used by the City for the previous month. 2. This Interlocal Agreement shall be in effect until either party gives a 10-day written notice of cancellation each to the other. 3. The actual operation of the chipper shall be by someone who is experienced in operating a brush chipper. 4. The City will be responsible for incidental repairs and maintenance of the chipper while it is in its possession. 5. The City shall have liability insurance coverage of $750,000.00 for use of the chipper. 6. The City does hereby indemnify the County, for any and all claims of any sort whatsoever that arise from the use of this chipper. In this respect, the City does agree to hold harmless and so assume any and all responsibility for any claims or damages resulting 'from the use of this chipper during the length of time wherein said use of the chipper continues. The City agrees in this regard to defend and pay any and all costs for said defense to include attorney's fees, costs of Court and all such expenses relating to said claims, should the same occur. In the event liability insurance is carried by the City that pro- vides coverage for the activities prescribed and shown in this agreement, that the County shall be shown thereon as a co-insured and a copy of said policy shall be forthwith made available to the County Administrator so reflecting. This Interlocal Agreement shall take effect when an executed copy is filed with the Clerk of the Court for the 16th Judicial Circuit for the State of Florida.
