RESOLUTION NO. 396-1986
RESOLUTION UPHOLDING THE DECISION OF THE
ZONING BOARD OF MONROE COUNTY, FLORIDA,
WITHOUT PREJUDICE, AND DENYING THE REQUEST OF
BONEFISH YACHT CLUB, LTD. TO REVERSE THE
DECISION OF THE ZONING BOARD OF MONROE COUNTY
FLORIDA, WHICH DENIED ITS REQUEST FOR A TIME
EXTENSION TO COMPLETE UNFINISHED UNITS WITHIN
AN APPROVED MAJOR DEVELOPMENT.
WHEREAS, on September 24, 1986, the Zoning Board of Monroe
County, Florida, denied a request for a time extension to
complete unfinished units within an approved major development
for the following described property:
located on a portion of Coco Plum Beach as recorded
in Plat Book 4, Page 166 of the Public Records of
Monroe County, Florida, and being more particularly
described by metes and bounds, known as parcel 111.
Also, Parcel #2, a tract of land in a part of Block 6,
of Coco Plum Beach, as recorded in Plat Book 4, Page
166 of the Public Records of Monroe County, Florida,
and more particularly described by metes and bounds.
Also, Parcel #3, portions of Coco Plum Beach, as
recorded in Plat Book 4, Page 166 of the Public Records
of Monroe County, Florida, and being more particularly
described by metes and bounds on the submitted survey.
Located on Coco Plum Beach Drive in Section 4, Township
66 South, Range 33 East, MM 54, Crawl Key No.3.
WHEREAS, Bonefish Yacht Club, Ltd. has duly appealed said
decision to the Board of County Commissioners of Monroe County,
Florida, sitting as the Board of Appeals, and the Board having
reviewed the transcript of the September 24, 1986 hearing, having
considered the argument of all parties present wishing to speak
on the matter, and all premises considered, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, sitting as the BOARD OF APPEALS, as
follows:
1. That the September 24, 1986, decision of the Zoning
Board of Monroe County, Florida, denying a reques t for a time
extension to complete unfinished units within an approved major
development for the above-described property be, and the same is
hereby upheld.
2. That said Bonefish Yacht Club, Ltd. be, and its is
hereby denied a reversal of the decision of the Zoning Board of
Monroe County, Florida, which denied its reques t for a time
extension to complete unfinished units within an approved major
development for the above-described property.
3. That the Clerk is hereby directed to make available to
the Field Representative of the Department of Community Affairs a
certified copy of this resolution by certified mail to said Field
Representative, Post Office Box 990, Key West, Florida 33041,
return receipt requested.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, sitting as the Board of Appeals, at a
regular meeting of said Board held on the 29th day of December,
A.D. 1986.
