RESOLUTION NO. 005 -1985
A RESOLUTION AUTHORIZING THE CHAIRMAN OF THE
BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA, TO APPROVE AND EXECUTE AN
AGREEMENT BY AND BETWEEN FRANK KEEVAN & SON,
INC. AND THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, CONCERNING THE BOAT-
ING IMPROVEMENT FUND PROJECT AT LAKES
WATERWAY PASSAGE, KEY WEST TO BOCA GRANDE,
MONROE COUNTY, FLORIDA, PHASE 2.
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, that the Chairman of the Board of County
Commissioners of Monroe County, Florida, is hereby authorized to
approve and execute an agreement by and between Frank Keevan &
Son, Inc. and the Board of County Commissioners of Monroe County,
Florida, a copy of which is attached hereto, concerning the
Boating Improvement Fund Project at Lakes Waterway Passage, Key
West to Boca Grande, Monroe County, Florida, Phase 2.
PASSED AND ADOPTED by the Chairman of the Board of County
Commissioners of Monroe County, Florida, at a regular meeting of
said Board held on the 11th day of January, A,D. 1985,

WITNESSETH, that the Contractor and the Owner for the consideration
hereinafter namedagree as follows:
1. The Contractor shall furnish all the materials and perform all the
work as requi red by the Specifi cations for Boati ng Improvement Fund Project
at Lakes Waterway Passage, Key West to Boca Grande, ~haase 2,
Monroe County, Florida, a copy of which is attached hereto and made a part
hereo f.
2. The work to be performed under the contract shall be commenced within
twenty-one (21) days from date Owner provides Notice to Proceed and be completed
within 60 days from date of commencement.
3. Further, the parties agree that if the Notice to Proceed has not been
given by Owner to Contractor on or before
May 31, 1985
that this Agreement shall be null and void.
4. Further, the work to be performed under the contract is contingent
upon receipt of appropriate grant monies from the State Department of Natural
Resources, Boating Improvement Fund and the Contractor will complete all
necessary certifications as requested.
5. The Owner shall pay to the Contractor for the performance of the

contract the sum of Fourteen thousand and two hundred dollars ($14,200)
upon completion by Contractor and acceptance by Owner, subject to terms and
conditions of paragraphs 3 and 4 above.
6. The attached Specifications together with this agreement, form the
contract and they are as fully a part of this contract as if herein repeated.

SPECIFICATIONS FOR INSTALLATION OF DAYBEACONS TO MARK
THE ClLU"lNEL IN "LAKES" SECTION BETWEEN KEY WEST AND
BOCA GRANDE KEY, FLORIDA KEYS, MONROE. COUNTY, FLORIDA
.
Sealed bids will be received by the Board of County Commissioners, Monroe
County, Key West, Florida
, at which time all bids will be publicly opened
and read aloud for installation of Daybeacons in the "Lakes" area between
Key West and Boca Grande Key,
Specifications for installation of treated wood piles complete with U.S.
Coast Guard approved Daybeacons, in the location indicated on the enclosed
section, are included here.
1, PILES: (A) Pile shall be of timber treated with chrQmated copper
arsenate (C.C.A.)
(B) Pile shall be of timber which will stand the driving
for which they are intended.
(C) A straight line drawn from the center of the butt to
the center of the tip shall not at any point, face
furtiler away from center of the pile than a distance
equal to 1% of the length of the pil~,
(D) Minimum butt diameter = 12" measured 3' from end,
Minimum tip diameter = 8",
(E) Pile shall be driven and best installation practices
used.
2, LEHGTH OF PILES: Pile to be of sufficient length to provide a
minimum of four feet penetration into the existing sea floor and
a minimum elevation of 8 feet above.1!Iean .high water,
3, DAYBEACOclS: Daybeacons to be constructed and erected as indicated
on the enclosed sketches. There are two daybeacons per dayrnark.
(A) Install green squares (SG) No, 13 to .be one mile nominal
visibility and be a double pile, and No. 11 to be ~ mile
nominal,
(B) Install red triangles (TR) Nos, 12, 8, 6, 4, and 2 to be
~ mile nominal visibility,
(C) Install 1 TR Harker No, 10 to be 3 mile nominal, This
is special dimension: 8' wide at base and 8' high,
4, DEMOLITION: If pile needs replacing.
5. CERTIFICATION:
(A) Bidder will certify that the plans and specifications
of the project will comply with the project design
. criteria established by the Department of Natural
Resources and will, if carried out, result in completed
facilities incorporating acceptable engineering design
standards, which facilities will be structually sound,
safe and suitable for their location and intended use,
(B) Bidder must also certify completion of the project
in accordance with 5, (A) and in accordance with
Coast Guard Requirements and the Coast Guard Permit
enclosed.
(C) Bidder will certify location of installed pile by
latitude and longitude upon completion of the work,
6, Contract shall specify number of days required to complete work.
The Board of County Commissioners reserves the right to accept (
rej~ct any and all bids,
All bids to remain valid for 120 days after bid selection by I
Board of County Commissioners or until contract is in effect all.
for new dates, whichever comes sooner,
Performance Bond required in accordance with Florida Statut
Chapter 255. If your bid or proposal exceeds $25,000, it will
necessary to post a Performance Bond.

Dear Mr. Fisher:
I am pleased to enclose the approved form CG-2554 authorizing the
establishment of Lakes Passage Daybeacons 2, 4, 6, 8, 10, 11, 12 and 13. This
authorization is issued under the following conditions:
Compliance with these and other conditions of the application is essential. You
must not deviate from this application unless modification is submitted to and
approval received from the U. S. Coast Guard.
That you advise the Commander, Seventh Coast Guard District (oan)
im mediately when the aids are actually established. At that time, the Coast
Guard will issue appropriate notices to mariners which will update the Light
List and nautical charts.
These private aids to navigation shall be maintained in proper condition at all
times. They will be inspected by the Coast Guard after establishment and
thereafter at any time and without prior notice to the maintainer.
A discrepancy exists whenever an aid is not as described in the approved
application. Any discrepancy in the operation of an aid at any time shall be
reported to the District Commander by telegram, or other rapid means of
commlmication in order that notices to mariners may be issued. Discrepancies
are to be corrected at once and reported by the same method.
The applicant agrees to save the Coast Guard harmless with respect to any
claim or claims that may result from the alleged negligence of the maintenance
or operation of the approved aids.

Changes in ownership must be approved by the U. S. Coast Guard.
Discontinuance and removal procedures should be requested from us.

notified in writing, the approved application is automatically cancelled.

understood that when any aid to navigation is established, whether federal or
:?rivate, this information is published'.immediately and then carried on future
editions of appropriate charts and in the Light List. Thereafter, mariners have
the t'ight to expect the aid to display. the advertised signal. Discrepancies left
uncorrected may result in marine casualties and resultant litigation.
