RESOLUTION NO. 122-1985
A RESOLUTION OF THE BOARD OF COUNTY COMMIS-
SIONERS OF MONROE COUNTY, FLORIDA, INDICATING
AN INTENT OF POLICY AUTHORIZING RENEWAL OF
SPECIALTY CONTRACTOR LICENSES AND DIRECTING
THE COUNTY ATTORNEY TO CORRECT CODE ERRORS
RELATING TO SPECIALTY CONTRACTORS.
WHEREAS, the Board of County Commissioners of Monroe County,
Florida, recognizes that Monroe County should deal fairly and
equally with persons pursuing certain livelihoods, and that the
County cannot administratively or in statute restrain trade by
placing undue hardship without cause and cannot unreasonably
interfere with specialty certifications for continuance of
livelihoods, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, as follows:
1.
That
the
Commission hereby
recognizes
previous
administrative inclusions of certain specialty contractors as
permissible and proper for issuance and renewal of specialty
Certificates of Competency, including those under reciprocating
municipalities.
2. That the Commission hereby directs the County Attorney
to address corrections to the Monroe County Code to include:
(a) Those authorized specialty contractor categories, and
(b) Clarification that all Certificates of Competency,
including Specialty Certificates of Competency, shall
be approved or disapproved by the Building Director,
except those for which standardized tests are available
to ascertain competency for State certificates, in
which case the provisions of Section 6-59 of the Monroe
County Code shall apply.
3. The Commission also hereby directs the Building Director
to issue new and renewal Specialty Certificates of Competency
held in abeyance after the opinion of the County Attorney of
March 20, 1984, based on the above intent.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the 12th day of April, A.D, 1985.
