RESOLUTION NO. 177-1985
RESOLUTION UPHOLDING THE DECISION OF THE
BOARD OF ADJUSTMENT OF MONROE COUNTY,
FLORIDA, WITHOUT PREJUDICE, AND DENYING THE
REQUEST OF CONRAD GRILL TO REVERSE THE
DECISION OF THE BOARD OF ADJUSTMENT OF MONROE
COUNTY FLORIDA, DISMISSING AN ADMINISTRATIVE
APPEAL FOR THE BOARD TO REVERSE THE DECISION
OF THE BUILDING DIRECTOR IN VOIDING PERMIT
ItC-13198.
WHEREAS, on March 1, 1985, the Board of Adjustment of Monroe
County, Florida, dismissed an administrative appeal for the Board
to reverse the decision of the Building Director in voiding
permit ItC-13198 for the following described property:
Lot 10, Block 5, Harbor Shores, Key Largo.
WHEREAS, Conrad Grill has duly appealed said decision to the
Board of County Commissioners of Monroe County, Florida, sitting
as the Board of Appeals, and the Board having reviewed the
transcript of the March 1, 1985 hearing, having considered the
argument of all parties present wishing to speak on the matter,
and all premises considered, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, sitting as the BOARD OF APPEALS, as
follows:
1. That the March 1, 1985, decision of the Board of
Adjustment of Monroe County, Florida, dismissing an admini-
strative appeal for the Board to reverse the decision of the
Building Director in voiding permit ItC-13198 be, and the same is
hereby upheld.
2. That said Conrad Grill be, and he is hereby denied a
reversal of the decision of the Board of Adjustment of Monroe
County, Florida, dismissing an administrative appeal for the
Board to reverse the decision of the Building Director in voiding
permit ItC-13198 for the above-described property.
3. The County Administrator is to review the question of
the validity of the permit based on all the facts, to reissue the
permit if warranted, and to report his findings and actions back
to the County Commission.
4. That the Clerk is hereby directed to make available to
the Field Representative of the Department of Community Affairs a
certified copy of this resolution by certified mail to said Field
Representative, Post Office Box 990, Key West, Florida 33041,
return receipt requested.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, sitting as the Board of Appeals, at a
regular meeting of said Board held on the 19th day of June, A.D.
1985.
