RESOLUTION NO. 264 -1985
RESOLUTION REVERSING THE DECISION OF THE
BOARD OF ADJUSTMENT OF MONROE COUNTY,
FLORIDA, WITHOUT PREJUDICE, AND APPROVING THE
REQUEST OF KATRINA BOYD TO REVERSE THE
DECISION OF THE BOARD OF ADJUSTMENT OF MONROE
COUNTY, FLORIDA, DENYING A DIMENSIONAL
VARIANCE TO BUILD UP TO FIVE FEET OF THE
NORTH SIDE PROPERTY LINE.
WHEREAS, on July 2, 1985, the Board of Adjustment of Monroe
County, Florida, denied a dimensional variance to build up to
five feet of the north side property line on the following
described property:
Lot 3, Block 2, Largo City, according to plat thereof
as recorded in Plat Book 4, Page 142 of the Public
Records of Monroe County, Florida. Located in Section
12, Township 61 South, Range 39 East. Zoned BU-2.
WHEREAS, Katrina Boyd has duly appealed said decision to the
Board of County Commissioners of Monroe County, Florida, sitting
as the Board of Appeals, and the Board having reviewed the
transcript of the July 2, 1985 hearing, having considered the
argument of all parties present wishing to speak on the matter,
and all premises considered, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, sitting as the BOARD OF APPEALS, as
follows:
1. That the July 2, 1985 decision of the Board of
Adjustment of Monroe County, Florida, denying a dimensional
variance to build up to five feet of the north side property line
be, and the same is hereby reversed and modified as hereafter
described.
2. That said Katrina Boyd be, and she is hereby granted a
reversal and modification of the decision of the Board of
Adjustment of Monroe County, Florida, denying a dimensional
variance to build up to five feet of the north side property line
on the above-described property.
3. That the applicant be granted the variance applied for,
modified to allow 10' side setback on north side and 20' side
setback on south side of the property.
4. That the Clerk is hereby directed to make available to
the Field Representative of the Department of Community Affairs a
certified copy of this resolution by certified mail to said Field
Representative, Post Office Box 990, Key West, Florida 33041,
return receipt requested.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, sitting as the Board of Appeals, at a
regular meeting of said Board held on the 18th day of September
A.D. 1985.
