Resolution 294-1985 Mayor Wilhelmina Harvey RESOLUTION NO. 294-1985 WHEREAS, it is anticipated that the Governor of Florida intends to request the Florida Legislature to amend the Marketable Record Title Act to retroactively exempt all previously state owned navigable waterways from the operation of said act; and WHEREAS, the cost of litigating claims if the act were amended would be astronomical to the taxpayers of the State of Florida; and WHEREAS, the public's right to use and enj oy the present waters of the State of Florida is protected by other laws and regulations of the State of Florida; and WHEREAS, the transferring of waterfront property from private owners to the State of Florida would remove said property from the tax base of Monroe County with a result in loss of ad valorem taxes; and WHEREAS, this issue is not such to justify a special session to the Florida Legislature; now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, as follows: 1. That the Florida Legislature be requested to not amend the Marketable Record Title Act as requested by the Governor, and the Governor of Florida be requested to not call a special session of the Legislature to consider the Marketable Record Title Act. 2. That the local legislative delegation is requested to vote against such amendment and encourage their fellow legi- slators to also vote against the amendment. 3. That copies of this Resolution be mailed to the Board of County Commissioners of each County in Florida to the attention of its Chairman, and to all members of the Florida Legislature and furnished to all local media and the Key West Citizen, The Keynoter and The Reporter.
