RESOLUTION NO. 444- 1994
A RESOLUTION STATING THE INTENT OF THE BOARD OF
COUNTY COMMISSIONS OF MONROE COUNTY, FLORIDA, TO
USE THE UNIFORM AD VALOREM METHOD FOR THE
COLLECTION OF NON-AD VALOREM ASSESSMENTS IN THE
CUDJOE GARDENS MUNICIPAL SERVICE CULVERT DISTRICT
AND STATING THE REASON THEREFOR.
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, as follows:
Section 1. The Board of County Commissioners as the governing body
of the Cudjoe Gardens Municipal Service Culvert District (District) declares its
intent to use the uniform ad valorem method for the collection of non-ad valorem
assessments as authorized by Sec. 197.3632, Fla. Stat. The non-ad valorem
assessment will be levied against non-exempt real property within the District.
The District is more particularly described as follows:
Cudjoe Gardens 1 st Addition, PB4/105, excluding Lots 1-7 Block 8;
Cudjoe Gardens 2nd Addition, PB4/159, excluding Lots 14-17 Block 2,
Lots 14-49 Block 3, Lots 13-15 Block 4;
Cudjoe Gardens 3rd Addition, PB5/7;
Cudjoe Gardens 5th Addition, PB6/88, excluding Lots 1-17 Block 16;
Cudjoe Gardens 6th Addition, PB6/66, excluding Lot 14 Block 17, Lot 14
Block 18, and Lot 16 Block 19;

Section 2. The canal water quality within the District is poor. The levy is
needed to finance the construction of culverts to improve the circulation of water
in the canals and hence to improve water quality.
Section 3. The Clerk is directed to send certified copies of this resolution
by January 10, 1995, to:
a) The Property Appraiser
b) The Tax Collector
c) The Florida Department of Revenue.
PASSED and ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of the Board held on the 14th day of
December, 1994

of collecting non-ad valorem assess-
ments levied by the Commission as
set forth in Sec. 197.3632, Fla. Stat.,
and that the Commission will hold a
public hearing on Wednesday, De-
cember 14, 1994, at 10:00 a.m. at
the Marathon Government Center,
2798 Overseas Highway, Marathon,:
Monroe County, Florida.
The purpose of the public hearing is
to consider the adoption of a Resolu-
tion authorizing the Commission to
use the uniform as valorem method
of collecting non-ad valorem assess-
ments levied by the Commission as
provided in Section 197.3632, Fla.
Stat.
The Commission is considering
adopting a non-ad valorem assess-
ment for the year 1995.
This non-ad valorem assessment is:
1. Levied for the first time; 2. Levied
for the purpose of constructing cul-
verts for various canals within the
District.
Interested parties may appear at the
public hearing to be heard regarding
the use of the uniform ad valorem
method of collecting such non-ad va-
lorem assessments.
Pursuant to Section 286.0105, Flor-
ida Statutes, notice is given that if a
person decided to appeal any deci-
sion made by the Board with respect
to any matter considered at such
hearings or meetings, he will need a

record of the proceedings, and that,
for such purpose, he may need to en-
sure that a verbatim record of the
proceedings is made, which record
includes the testimony and evidence
upon which the appeal is to be
based.
