Resolution 359-1985 Jeff Fisher, Director Extension Service RESOLUTION NO. 359-1985 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, AUTHORIZING THE EXECUTION OF AN INTERLOCAL AGREEMENT BY AND BETWEEN MONROE COUNTY, FLORIDA AND THE CITY OF KEY WEST, FLORIDA, CONCERNING THE SIMONTON STREET PROJECT. BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA that the Mayor and Chairman of the Board of County Commissioner of Monroe County, Florida, is hereby authorized to execute an Interlocal Agreement by and between Monroe County, Florida, and the City of Key West, Florida, a copy of the same being attached hereto, concerning the Simonton Street Project. I ler I ~;;'Z~~ ~~Fr;:/ORM i\ A~ICIEN~ /1 BY ~j Attomey's Office - - ".., " ~ i INTERLOCAL AGREEMENT THIS AGREEMENT entered into by and between Monroe County, Florida, hereinafter referred to as "County", and the City of Key West, Florida, hereinafter referred to as "City", now, therefore, BE IT UNDERSTOOD that this Interlocal Agreement is to ratify and clarify any understanding by the two parties relative to the Simonton Street Project; said project shall be as follows: To reconstruct and repair the boat ramp, to construct and repair the adjacent concrete piers, to pave, landscape and light a portion of the parking lot that is designated for boat trailer traffic only, and to require signs designating that the same shall be used for boat ramps and trailers only. This Agreement shall contain the following: 1. Three phases of said Project in that Phase I concerns ,Monroe County, whereas Phases II and III are being funded entire- ly by the City. 2. As part of Phase I, the City will advertise bids for said Project and will defray the cost of said advertisements and will furnish to the County proof of said advertisements. The work to be done in Phases I, II, and III will be set forth in said advertisements. 3. That after bids or proposals have been received accord- ing to existing legal requirements by the official representa- tives of the parties hereto, Jeff Fisher and Randy Sterling, they will then jointly recommend the Contractor whose bid or proposal is the lowest and most advantag~ous for Phase I and they will then work in direct consultation with the City Bid Committee, and this said contract must then be approved by the Monroe County Commission prior to the commencement of work. When this Contract between the Contractor and the City and the County has been approved, the Contract shall then become operational. 4. The County, through its representative, and the Monroe County Commission shall approve a Project Application to the Department of Natural Resources for the use of the Boating Improvement Fund that will be utilized in Phase I hereof. 5. Any Boating Improvement Fund Project Agreement will be entered into by the County Commission together with the Depart- ment of Natural Resources. Should it be necessary, because of the requirements of the Department of Natural Resources for the City to be part of the Agreement, the City hereby agrees to enter into such agreement. 6. The Notice to Proceed to the Contractor on Phase I will be afforded to the Contractor by the County Administrator and the representative of the County herein, Jeff Fisher. 7. The City will be responsible for the supervision and overseeing and the completion of the entire Project, which includes Phase I. A certification that Phase I has been complet- ed satisfactory to the City will be furnished to Monroe County. 8. It is understood by these parties that the City will commence Phases II and III of said Project at that time Phase I is commenced and that said Phases shall be worked on in concert and completed together as quickly as possible. 9. Payments on the contract to be entered into under paragraph 3 hereof will be made by the County from the Boating Improvement Fund. In turn, the City will make payments to the Contractor for Phases II and III. 10. Under the rules .of the Boating Improvement Fund, the City does agree to the continuous maintenance of ramps, docks, and trailer parking lots at the expense of the City for twenty- five (25) years and that said improvements to be afforded and maintained shall include public road access for twenty-five (25) years. 11. Because of the use of Boating Improvement Fund monies, the County has concern over the maintenance and management of the facility. In addition, the area in question is well known as an area for derelicts and drifters. To avoid the potential problems of vandalism and abuse, the City of Key West certifies to Monroe County to develop rules and regulations concerning the operation of the facility to include hours of operation, security, polic- ing, signage and maintenance. The City agrees to take full responsibility for the repair, maintenance and upkeep, and 2 , . guarantees to the County to maintain the property in high quali- ty, working condition. 12. This Interlocal Agreement supplements and is an addi- tion to that certain contract that was approved by Resolution No. 58-1984 and Resolution No. 57-1984 of the County and Resolution No. 84-64 of the City. THIS AGREEMENT entered into by and between the parties hereto on the da y 0 f , 1985, contains all the understanding and agreements between the parties.
