RESOLUTION NO. 041-1984 RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, SUPPORTING THE PETITION FOR ROAD ABANDONMENT SUBMITTED BY JEROME V. SHIPLEY, ESQ. FOR DONALD KOSIN, REFUGE MANAGER, UNITED STATES FISH AND WILDLIFE SERVICE, BIG PINE KEY, FLORIDA. WHEREAS, the Board of County Commissioners of Monroe County, Florida, is hereby in receipt of a Petition for Road Abandonment submitted by Jerome V. Shipley, Esquire, for Donald Kosin, Refuge Manager, United States Fish and Wildlife Service, Big Pine Key, Florida, and WHEREAS, Donald Kosin, Refuge Manager, United States Fish and Wildlife Service, desires to have Monroe County, Florida, abandon the following described road, to-wit: that portion of Crane Boulevard on Upper Sugar10af Key which begins at a point where the southwestern corner of the unimproved road right-of-way owned by Monroe County as recorded in O.R. 445 at pages 854-857 of the Public Records of Monroe County, Florida, intersects with Crane Boulevard at its northern right-of-way and thence proceeding westerly along the northern right-of- way of Crane Boulevard to the point where Crane Boulevard dead ends at Upper Sugar10af Sound and thence southerly to the southwestern corner of the Crane Boulevard right-of-way and thence proceeding easterly along the southern right-of-way of Crane Boulevard to a point intersected by an imaginary southerly extension of the western right-of-way line of the aforementioned unimproved Monroe County right-of-way and thence northerly to the point of beginning. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that the Board of County Commissioner of Monroe County, Florida, hereby supports and advocates the above-mentioned Petition for Road Abandonment as submitted by Jerome V. Shipley, Esquire, for Donald Kosin, Refuge Manager, United States Fish and Wildlife Service, Big Pine Key, Florida. PASSED AND ADOPTED by the Board of County Commissioners of Monroe County, Florida, at a regular meeting of said Board held on the 27th day of January, A.D. 1984. " PET I T ION (ROAD ABANDONMENT) TO: The Board of County Commissioners Monroe County, Florida Donald Kosin, Refuge Manager, United States Fish and Wildlife Service, Big Pine Key, Florida, by and through the undersigned attorney, petitions the Honorable Board of County Commissioners of Monroe County, Florida, to renounce and dis- claim:any right of the County and the public in and to the hereinafter described road as delineated on the attached plat , map, to-wit:, that portion of Crane Boulevard on Upper Sugar loaf Key which begins at a point where the southwestern corner of the unimproved road right-of-way owned by Monroe County as recorded in 0, R. 445 at pages 854-857 of the Public Records of Monroe County, Florida, intersects with Crane Boulevard at its northern right-of-w~ and thence proceeding westerly along the northern right-of-way of Crane Boule- vard to the point where Crane Boulevard dead- ends at Upper Sugarloaf Sound and thence south- erly to the southwestern corner of the Crane Boulevard right-of-way and thence proceeding easterly along the southern right-of-way of /-Crane Boulevard to a point intersected by an imaginary southerly extension of the western right-of-way line oD the aforementioned unim- proved Monroe County~ight-of-way and thence northerly to the point of beginning, The United States of America is the sole owner of Lot 5, Section 22, Range 27, Township 66, Parcel account no. RE 11729, as recorded in O. R, 805 at pages 20 - 23 of the Public Records of Monroe County, Florida, Attached to this Petition and made a part hereof and marked Exhibit "All is the plat map of a portion of Upper Sugar Loaf Key with the property owned by the Petitioner out- lined in heavy blak ink and that portion of Crane ,Boulevard Petitioner seeks to have abandoned marked with diagonal red lines, Petitioner seeks to have the above-described portion of Crane Boulevard abandoned because it is completely within the boundaries of lands owned and administered by the United States Fish and Wildlife Service. Petitioner wishes to close the road to prevent dumping of trash and further intends to remove a portion of the road to improve water circulation. This aban- donment will not take away any other property owners right of ingress or egress to their property, Petitioner agrees to be responsible and pay'for all costs of advertising and recording fees incurred relative to this request for the abandonment of said roadway. Petitioner further agrees to furnish this Board with letters of no objections from the various utility companies concerned in this matter. Petitioner hereby states that the ~nly adjacent proper~y owner is Monroe County, Florida, whose ~ngress and egress w~ll be unaffected by this abandonment. WHEREFORE, Petitioner respectfully requests the Honorable Board of County Commissioners of Monroe County, Florida to grant this Petition. Respectfully submitted, Jerome v. Shipley, Esq.
