RESOLUTION REVERSING THE DECISION OF THE
BOARD OF ADJUSTMENT OF MONROE COUNTY,
FLORIDA, WITHOUT PREJUDICE AND APPROVING THE
ADMINISTRATIVE APPEAL OF LLOYD A. GOOD, JR.
TO REVERSE THE DECISION OF THE BOARD OF
ADJUSTMENT OF MONROE COUNTY, FLORIDA,
DECLARING THE PROPERTY BE DEEMED A MAJOR
DEVELOPMENT, PURSUANT TO CHAPTER 6-222(7)(b)
OF THE MONROE COUNTY CODE
WHEREAS, the Board of Adjustment of Monroe County, Florida,
on November 2, 1983, denied the administrative appeal of Lloyd A.
Good, Jr. and declared the following described property to be a
Major Development, pursuant to Chapter 6-222(7)(b) of the Monroe
County Code:
Section C Extension of Sugar10af Shores Subdivision, as
located in Section 2, Township 67 South, Range 27 East
on Sugar10af Key, Monroe County, Florida.
WHEREAS, Lloyd A. Good, Jr. has duly appealed said decision
to the Board of County Commissioners of Monroe County, Florida,
sitting as the Board of Appeals, and the Board having reviewed
the transcript of the November 2, 1983 hearing, having considered
the argument of all parties present wishing to speak on the
matter, and all premises considered, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, sitting as the BOARD OF APPEALS, as
follows:
1. That the decision of the Board of Adjustment of Monroe
County, Florida, on November 2, 1983, denying the administrative
appeal of Lloyd A. Good, Jr. and declaring the above described
property to be a Major Development, pursuant to Chapter
6-222(7)(b) of the Monroe County Code, be, and the same is hereby
reversed.
2. That the said Lloyd A. Good, Jr. be, and he is hereby
granted a reversal of the decision of the Board of Adjustment of
Monroe County, Florida, denying an administrative appeal and
declaring the above described property as a Major Development.
3. The Board of County Commissioners remand this matter to
the Planning and Building Department for processing of this
dredge and fill permit through normal and proper procedures.
4. The Board of County Commissioners retain jurisdiction
over this matter for review of any action by the Planning and
Zoning Department in denying or approving this application for
any other reasons.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
