RESOLUTION REVERSING THE DECISION OF THE
BOARD OF ADJUSTMENT OF MONROE COUNTY,
FLORIDA, WITHOUT PREJUDICE AND GRANTING THE
REQUEST OF MARATHON MASONIC LODGE #232 TO
REVERSE THE DECISION OF THE BOARD OF
ADJUSTMENT OF MONROE COUNTY, FLORIDA, AND
GRANTING A DIMENSIONAL VARIANCE TO MARATHON
MASONIC LIDGE #232
WHEREAS, the Board of Adjustment of Monroe County, Florida,
on October 5, 1983, denied a dimensional variance on the
following described property:
A variance to the square footage, width and depth
requirements for a proposed change of zoning to BU-1-M.
Also, requesting a variance of 31.35 feet, to build up
to 18.65 feet from the front setback line, and a
variance of 11.32 feet, to build up to 13.68 feet from
the rear property line on Lot 1, Block 2 of Gulf Stream
Shores, Plat #1, as recorded in Plat Book 3, Page 89,
and located in Section 1, Township 66 South, Range 32
East. Marathon. Zoned RU-3.
WHEREAS, Marathon Masonic Lodge #232 have duly appealed said
decision to the Board of County Commissioners of Monroe County,
Florida, sitting as the Board of Appeals, and the Board having
reviewed the transcript of the October 5, 1983 hearing, having
considered the argument of all parties present wishing to speak
on the matter, and all premises considered, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, sitting as the BOARD OF APPEALS, as
follows:
1. That the decision of the Board of Adjustment of Monroe
County, Florida, on October 5, 1983, denying a dimensional
variance as requested by Marathon Masonic Lodge #232 be, and the
same is hereby reversed.
2. That the said Marathon Masonic Lodge #232 be, and they
are hereby granted a reversal of the decision of the Board of
Adjustment of Monroe County, Florida, denying a dimensional
variance on the above described property.
3. The Clerk of the Board of County Commissioners of
Monroe County, Florida, is hereby instructed to forward a
certified copy of this Resolution to the Secretary, Department of
Community Affairs, 2571 Executive Center Circle, East,
Tallahassee, Florida 32301.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
