RESOLUTION AFFIRMING THE DECISION OF THE
ZONING BOARD OF MONROE COUNTY, FLORIDA, AND
DENYING THE REQUEST OF THE FRIENDS OF THE
EVERGLADES, INC. TO REVERSE THE DECISION OF
THE ZONING BOARD OF MONROE COUNTY, FLORIDA,
GRANTING THE REQUEST OF CITY NATIONAL BANK AS
TRUSTEE PRELIMINARY APPROVAL OF A PROPOSED
MAJOR DEVELOPMENT PROJECT KNOWN A GARDEN COVE
AND COMMUNITY IMPACT STUDY, WITH A PRELIMI-
NARY CHANGE OF ZONING FROM GU, PUD, BU-2,
BU-2A TO PUD WITH A BU-2F.
WHEREAS, the Zoning Board of Monroe County, Florida, on
November 3, 1983, granted THE REQUEST OF City National Bank as
Trustee for preliminary approval of an application for a Major
Development and will consider an application for final approval
upon submission of a proper application and evidence that the
conditions listed in Zoning Board Resolution No. MD 83-20 have
been met with a preliminary change of Zoning from GU, PUD, BU-2,
BU-2A to PUD with a BU-2F for a Major Development Project known
as Garden Cove, on property described as:

and
WHEREAS, the Friends of the Everglades, Inc. have duly
appealed said decision to the Board of County Commissioners of
Monroe County, Florida, sitting as the Board of Appeals, and the
Board having reviewed the transcript of the November 3, 1983
hearing, having considered the argument of all parties present
wishing to speak on the matter, and all premises considered, now,
therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, sitting as the BOARD OF APPEALS, as
follows:
1. That the decision of the Zoning Board of Monroe County,
Florida, on November 3, 1983, regarding approval of the request
the City National Bank as Trustee for preliminary approval of a
Major Development Project with a preliminary Zoning change from
GU, PUD, BU-2, BU-2A to PUD with a BU-2F on the above described
property for project known as Garden Cove, be, and the same is
hereby affirmed,
2, That the Friends of the Everglades, Inc. be, and they
are hereby denied a reversement of the decision of the Zoning
Board of Monroe County, Florida, granting the request of City
National Bank as Trustee for preliminary approval of a Major
Development Project with a preliminary change of Zoning from GU,
PUD, BU-2, BU-2A to PUD with a BU-2F on the above described
property for project known as Garden Cove,
3. The Clerk of the Board of County Commissioners of
Monroe County, Florida is hereby instructed to forward a cer-
tified copy of this Resolution to the Secretary, Department of
Community Affairs, 2571 Executive Center Circle, East,
Tallahassee, Florida 32301,
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
