Resolution 118-1984 Keys Title & Abstract Company RESOLUTION NO. 118-1984 RESOLUTION AUTHORIZING THE CHAIRMAN OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, TO EXECUTE A PARTIAL RELEASE OF AGREEMENT BY AND BETWEEN THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA AND SCHARF LAND DEVELOPMENT COMPANY. BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, as follows: That the Mayor and Chairman of the Board of County Commis- sioners of Monroe County, Florida, is hereby authorized to execute a Partial Release of Agreement by and between the Board of County Commissioners of Monroe County, Florida, and Scharf Land Development Company, a copy of same being attached hereto, for the purpose of releasing Lot 11, of a Rep1at of Block 5, Geiger Mobile Homes as recorded in Plat Book 5, Page 77, of the Public Records of Monroe County, Florida, as a partial release of that certain Agreement, upon payment of $13,200. PASSED AND ADOPTED by the Board of County Commissioners of Monroe County, Florida, at a regular meeting of said Board held on the 6th day of April, A.D. 1984. KOLHAGE, Clerk ~"'~ (\1\ 0~~ ,0 ,C C rk APPROVED AS TO FORM AN GAL SUFFICIENC BY PARTIAL RELEASE OF AGREEMENT WHEREAS, the County of Monroe, State of Florida, entered into an Agreement with SCHARF LAND DEVELOPMENT COMPANY, wherein said Developer agreed to construct certain streets as shown on plat of Tamarac Park, a subdivision in Monroe County, Florida, and in lieu of a bond guaranteeing said construction, Developer agreed to convey to said County Lots 8, 9, 10 and 11 of a Rep1at of Block 5, of said Plat as security for the construction and paving of said streets and delivered to said County a Warranty Deed conveying said land, and WHEREAS, the Director of the Monroe County Public Works Department has advised said County that said Developer has not constructed all the streets in said subdivision according to County specifications but recommends that the Deed being held conveying Lot 11 of a Rep1at of Block 5, should be returned to the Developer as a partial release, upon payment of $13,200.00, now, therefore, WITNESSETH, that the County of Monroe, State of Florida, hereby releases Lot 11 of a Replat of Block 5, as a partial release of that certain Agreement by and between the County of Monroe, State of Florida and SCHARF LAND DEVELOPMENT COMPANY, and upon payment of $13,200.00 said Lot 11 of a Replat of Block 5 is hereby released, but that all remaining obligations in accordance with said Agreement are in full force and effect.
