RESOLUTION NO. 119-1984
RESOLUTION AUTHORIZING THE CHAIRMAN OF THE
BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA, TO EXECUTE A RELEASE OF
AGREEMENT BY AND BETWEEN THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA AND
SCHARF LAND DEVELOPMENT COMPANY.
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, as follows:
That the Mayor and Chairman of the Board of County Commis-
sioners of Monroe County, Florida, is hereby authorized to
execute a Release of Agreement by and between the Board of County
Commissioners of Monroe County, Florida, and Scharf Land
Development Company, a copy of same being attached hereto, for
the purpose of releasing Lots 1 & 2, Block 15, Eden Pines Colony,
Fourth Addition, according to the Plat thereof as recorded in
Plat Book 6 at Page 79, of the Public Records of Monroe County,
Florida, upon full and complete payment of $27,809.31.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the 6th day of April, A.D. 1984.

RELEASE OF AGREEMENT
WHEREAS, the County of Monroe, State of Florida, entered
into an Agreement with SCHARF LAND DEVELOPMENT COMPANY, wherein
said Developer agreed to construct certain roads as shown on plat
of Eden Pines Colony Subdivision, a subdivision in Monroe County,
Florida, and in lieu of a bond guaranteeing said construction,
Developer agreed to convey to said County Lots 1 & 2, Block 15,
of said Plat as security for the construction and paving of said
roads and delivered to said County a Warranty Deed conveying said
land, and
WHEREAS, the Director of the Monroe County Public Works
Department has advised said County that said Developer has not
constructed all the roads in said subdivision according to County
specifications but recommends that the Deed being held conveying
Lots 1 & 2, Block 15, should be returned to the Developer upon
p~yment of $27,809.31, now, therefore,
WITNESSETH, that the County of Monroe, State of Florida,
hereby releases Lots 1 & 2, Block 15, Eden Pines Colony, Fourth
Edition of that certain Agreement bv and between the County of
Monroe, State of Florida and SCHARF LAND DEVELOPMENT COMPANY; and
upon full and complete payment of $27,809.31, said Lots 1 & 2, of
Block 15 are hereby released.
IN WITNESSETH WHEREOF, the County of Monroe, State of
Florida, has caused this Release of Agreement to be signed by its

I HEREBY CERTIFY that on this day of

the Board of County Commissioners of Monroe County, Florida, and
DANNY L. KOLHAGE, Clerk of the Circuit Court of Monroe County,
Florida, and Ex Officio Clerk of the Board of County
Commissioners of Monroe County, Florida, respectively, to me
known to be the persons described in and who executed the
foregoing Release of Agreement on behalf of the County of Monroe,
State of Florida, and severally acknowledged the execution
thereof to be their free act and deed as such officers, for the
uses and purposes therein mentioned; and that they affixed
thereto the seal of said Board of County Commissioners and that
said instrument is the act and deed of said County of Monroe,
State of Florida.
