Resolution 124-1984 BOARD OF COUNTY COMMISSIONERS RESOLUTION NO. 124 -1984 WHEREAS, the Board of County Commissioners of Monroe County, Florida, desires to renounce and disclaim any right of the County and the public in and to the hereinafter described streets, alley- ways, roads or highways, and WHEREAS, under Chapter 336, Florida Statutes, it is necessary to hold a public hearing after publishing due notice of said hearing in accordance with said Chapter, now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that at 10:00 A.M., Friday, May 4, 1984, at the Plantation Key Governmental Center, Plantation Key, Monroe County, Florida, said Board will hold a public hearing to determine whether or not said Board will renounce and disclaim any right of the County and the public in and to the following described streets, alley-ways, roads or highways: A parcel of land lying in Section 26, Township 67 South, Range 25 East, Monroe County, Florida, and being described as follows: FROM the intersection of the centerline of U.S. Highway No. 1 (as said highway existed in 1957) and the East face of the West abutment of the Boca Chica viaduct (as said viaduct existed in 1957) run' South 810 17' West for a distance of 3608.70 feet; thence North 050 45' 50" East for a distance of 206.56 feet to the Point of Beginning of the garcel of land being described herein, thence continue North 05 45' 50" East for a distance of 761.04 feet to the beginning of a curve, con- cave to the Northwest and having a radius of 263.27 feet; thence run Southwesterly along said curve for an arc distance of 164.94 feet; thence run South 050 45' 50" West for a distance of 619.59 feet; thence run North 810 17' East for a distance of 51.64 feet back to the Point of Beginning, containing 0.76 acres, more or less. BE IT FURTHER RESOLVED BY SAID BOARD that the Clerk of said Board be, and he is hereby ordered to publish notice of said meet- ing in accordance with the provisions of Chapter 336, Florida Statutes. BY PETITION TO RELOCATE A ROAD AND/OR TO VACATE ONE ROAD AND DEDICATE A NEW ROAD IN ITS PLACE TO: The Honorable Board of County Commissioners of Monroe County, Florida ARTHUR B. LUJAN AND BETTY L. LUJAN, his wife, by and through their undersigned attorney, petition the Honorable Board of County Commissioners of Monroe County, Florida, to relocate the road as delineated on the hereinafter described map or plat, or to renounce and disclaim any right of the County and the public in and to the use of said road and approve the dedication of a new road in its place, a copy of said map and survey are attached hereto as Exhibit A. Arthur B. Lujan and Betty L. Lujan, his wife, are the sole owners of all of the property abutting the road which it seeks to relocate or to vacate, more particularly described on Exhibits Band C, attached hereto. Arthur B. Lujan and Betty L. Lujan, his wife, are the sole owners of all of the property abutting that portion of the new road which they seek to dedicate in place of the old road, more particularly described on Exhibits Band D, attached hereto. Petitioners request that the County waive any requirement for appraisal or fees to be paid for the road to be vacated inasmuch as the Petitioner seeks to dedicate a new road to replace the one which is being vacated by the County. utilities will not be hindered or disturbed by the County vacating this road. See Exhibits E and F, attached hereto. Petitioner seeks to have the above described road relocated or vacated and a new road dedicated in its place. The abandonment of said road will not take away any other property holders right of ingress or egress to their property. The 1983 taxes on the land described herein, owned by Arthur B. Lujan and Betty L. Lujan, his wife, have been paid. Petitioners agree to be responsible to pay for all costs of advertising and recording fees incurred relative to this request for the relocation of and/or the abandonment of said roadway and the dedication of a new road in its place.
