RESOLUTION NO. 143 -1984
A RESOLUTION REQUESTING THE GOVERNOR TO PRO-
VIDE ADDITIONAL FUNDS FOR THE PUBLIC DEFENDER'S
OFFICE TO COMPENSATE FOR REPRESENTATIONS BE-
CAUSE OF THE CONFLICT OF INTEREST OCCASIONED
BY THE APPOINTMENT OF THE TEMPORARY PUBLIC DE-
FENDER.
WHEREAS, Governor Robert Graham appointed Randall Winter as
the temporary Public Defender, and
WHEREAS, it is obvious and clear that because Mr. Winter was
formerly in the State Attorney's office, that a conflict of interest
has arisen, and
WHEREAS, in a number of cases the Public Defender's office will
be unable to represent persons charged with crimes in this County, who
are entitled to representation by the Public Defender, and
WHEREAS, Monroe County will have to bare the costs of such de-
fenses where such a conflict as described heretofore has arisen, now,
therefore,
BE IT RESOLVED BY THE MAYOR AND COUNTY COMMISSION OF MONROE
COUNTY, FLORIDA, that:
1. Governor Bob Graham be, and he is hereby requested to have
provided to the public defender's office in Monroe County, a sum of
money, which will be utilized to defray the costs required for the
defense of those persons who are incapable of being represented by
the Public Defender because of the conflict created by said appoint-
ment.
2. That the Governor will request of the Legislature a means
and a method whereby these funds can be provided to the Public De-
fender's office here in Monroe County at the present Legislative
session as a Conflict of Interest fund.
3. That the fund to be created will be in a sum sufficient to
reimburse Monroe County for any monies needed or necessary for the
defense of any charges wherein the Public Defender will be unable to
defend because of conflict of interest.
4. That this County Commission does not dispute the Governor's
right to make the appointment heretofore made, and that nothing herein
has any reflection on the capacity and capabilities of Randall Winter
to handle said position, but is simply being stated for the purpose
of making this County whole because of the excessive expenses occa-
sioned by this appointment, which would not have been so except for
the conflicts stated herein.
Passed and adopted by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the 4th
