RESOLUTION NO. 146-1984
RESOLUTION REVERSING THE DECISION OF THE
BOARD OF ADJUSTMENT OF MONROE COUNTY,
FLORIDA, WITHOUT PREJUDICE AND APPROVING THE
REQUEST OF CARL, MARLENE, CARL, RAY, CRAIG &
BRIAN LINDBACK TO REVERSE THE DECISION OF THE
BOARD OF ADJUSTMENT OF MONROE COUNTY,
FLORIDA, DENYING A DIMENSIONAL VARIANCE
WHEREAS, the Board of Adjustment of Monroe County, Florida,
on January 24, 1984, denied the request of Carl, Marlene, Carl,
Ray, Craig & Brian Lindback for a dimensional variance as
described below:
A variance of 90 feet, to build up to 10 feet from the
front property line for a sewage treatment plant on a
parcel of land being a portion of the william H. Parker
Homestead, as located in Government Lots I, 2 and 3,
Section 6, Township 64 South, Range 37 East. Upper
Matecumbe Key. Zoned RU-3. Multiple Family.
WHEREAS, Carl, Marlene, Carl, Ray, Craig & Brian Lindback
have duly appealed said decision to the Board of County
Commissioners of Monroe County, Florida, sitting as the Board of
Appeals, and the Board having reviewed the transcript of the
January 24, 1984 hearing, having considered the argument of all
parties present wishing to speak on the matter, and all premises
considered, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, sitting as the BOARD OF APPEALS, as
follows:
1. That the decision of the Board of Adjustment of Monroe
County, Florida, on January 24, 1984, denying the request of
Carl, Marlene, Carl, Ray, Craig & Brian Lindback for a
dimensional variance be, and the same is hereby reversed.
2. That the said Carl, Marlene, Carl, Ray, Craig & Brian
Lindback be, and they are hereby granted a reversal of the
decision of the Board of Adjustment of Monroe County, Florida,
denying a dimensional variance on the above-described property.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
