RESOLUTION NO.
152-1984
WHEREAS, the Board of County Commissioners of Monroe County,
Florida, desires to renounce and disclaim any right of the County
and the public in and to the easement in the hereinafter described
property, and
WHEREAS, under Chapter 336, Florida Statutes, it is necessary
to hold a public hearing after publishing due notice of said hear-
ing in accordance with said Chapter, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA, that at 10:00 A.M., Friday, June 1, 1984, in Court-
room "B" of the Monroe County Courthouse Annex, 500 Whitehead Street,
Key West, Monroe County, Florida, said Board will hold a public hear-
ing to determine whether or not said Board will renounce and disclaim
any right of the County and the public in and to the easement in the
following described property:
All of Lot 9 and a part of Lot 8, Block 2, KEY HAVEN TENTH
ADDITION as recorded in Plat Book 5 at Page 114 of the Public
Records of Monroe County, Florida, and more particularly de-
scribed as follows: BEGIN at a concrete monument at the
Northeast corner of said Lot 9 and run thence Southwesterly
along the curved right-of-way of Driftwood Drive, concave to
the Northwest and a radius of 712.66 feet, for an arc distance
of 10 feet to a concrete monument at the end of said curve and
the beginning of a second curve; continue southwesterly along
the curved right-of-way of the said Driftwood Drive, said second
curve being concave to the Southeast and a radius of 350 feet,
for an arc distance of 100 feet to a concrete monument; thence
run S 490 05' 13" E and radial to the said second curve, for a
distance of 135 feet to the Mean High Tide of Cypress Lake;
thence run Northeasterly and along the Mean High Tide of the
said Cypress Lake for a distance of 73 feet, more or less, to
a point on the dividing line between Lots 9 and 10 of the said
Block 2; thence run N 330 31' 14" W along the line between said
Lots 9 and 10 for a distance of 134 feet, more or less, back to
the Point of Beginning.
BE IT FURTHER RESOLVED BY SAID BOARD that the Clerk of said
Board be, and he is hereby ordered to publish notice of said hear-
ing in accordance with the provisions of Chapter 336, Florida Statutes.
Passed and adopted by the Board of County Commissioner of Monroe
County, Florida, at a regular meeting of said Board held on the1sth
day of May, A.D. 1984.

(VACATE DRAINAGE EASEMENT) •
TO: The Honorable Board of County Commissioners of Monroe County,
Florida
ROBERT J. PATERNO AND MARY DELL PATERNO, by .and through their
undersigned attorney, petitions the Honorable Board of County
Commissioners of Monroe County, Florida, to renounce and disclaim
any right of the County and the public in and to the use of the
. hereinafter described drainage easement as delineated on the
hereinafter described map or plat, copy of. which is attached hereto,
to-wit: . Plat of Key Haven, . Tenth Addition, as recorded in -
Plat Book 5, Page 114 , of the Public Records. of
Monroe. County, Florida.
ROBERT J. PATERNO AND MARY DELL PATERNO are the sole owners
of all of Lot 9 and a part of. Lot 8 , Block 2, KEY HAVEN TENTH
• ADDITION, as recorded in Plat Book 5 at Page 114 of the Public
Records of Monroe County, FLorida.. S
Attached to this Petition and made. a. part hereof and marked
Exhibit "A" is the map/plat/sketch of survey of Key Haven, Tenth
Addition, with the property owned by the Petitioner .outlined in
black and the drainage easement Petitioner seeks to have vacated
marked .with diagonal lines.
Petitioner seeks to have the above described drainage easement
vacated as it is no longer nedessary and presently lies in a place
where a home is intended to be built. • (.See attached letter, marked
Exhibit B. )
That the vacation of said easement will not take away' any :
other property holders ' rights.
That the 1983 taxes on the. land. described herein owned by
Robert J. Paterno and Mary Dell Paterno have been paid.
Petitioner agrees to be responsible to pay for all costs of
advertisin9 'and recording fees incurred relative to this request
for the vacation of said easement.
Petitioner is the sole owner of all of the property that abuts
this easement. • .
WHEREFORE, Petitioner respectfully requests the Honorable
Board of County Commissioners of Monroe County, Florida, to grant
this Petition.
