RESOLUTION NO, 169 -1984
A RESOLUTION OF THE BOARD OF COUNTY COMMIS-
SIONERS OF MONROE COUNTY, FLORIDA, EXTENDING
A CURRENTLY EXISTING MORATORIUM UPON THE
ISSUANCE OF NEW OCCUPATIONAL LICENSES FOR
MOBILE VENDORS AND PEDDLERS UNDER SECTIONS
12-48 AND 12-52 OF THE MONROE COUNTY CODE OF
ORDINANCES FOR A PERIOD OF THREE (3) MONTHS
AND PROVIDING FOR EXCEPTION FROM SAID MORA-
TORIUM FOR THOSE PERSONS APPLYING FOR
PEDDLERS LICENSES TO OPERATE MOBILE REPAIR OR
APPLIANCE SERVICE BUSINESSES NOT INVOLVING
THE SALE OF MERCHANDISE.
WHEREAS, a temporary moratorium upon the issuance of new
occupational licenses for mobile vendors and peddlers under
Sections 12-48 and 12-52 of the Monroe County Code of Ordinances
has been in effect since November 29, 1982, and
WHEREAS, said sections of the Monroe County Code are cur-
rently being studied by the County Attorney's Office, the Tax
Collector, the Sheriff and various personnel of the Department of
Building, Planning and Zoning with a view towards amendments
thereto to alleviate certain problems which have heretofore
arisen concerning mobile vendors and peddlers of products within
the unincorporated areas, and
WHEREAS, proposed amendments to these sections of the Monroe
County Code are anticipated within three (3) months hereof, and
WHEREAS, the problems which have arisen due to mobile
vendors and peddlers of products were not caused by mobile
service or appliance repair occupations and that continuing the
moratoriums to such service related mobile occupations is not in
the best interests of, or concern the health, safety and welfare
of the citizens of the County, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, as follows:
1. Excepting those occupations described in paragraph two
(2) hereinbelow, the moratorium upon the issuance of new occupa-
tional license for mobile vendor and peddlers under Sections
12-48 and 12-52 of the Monroe County Code of Ordinances declared
on November 29, 1982 shall and is hereby extended for a period of
three (3) months.
2, This moratorium shall not be construed to prohibit the
issuance of occupational licenses to those persons who hereafter
apply for such licenses to undertake service related occupations,
such as mobile appliance repair and service, including such
occupations as television, kitchen or household appliances,
electronic devices and their appurtenances, and motor vehicle and
vessel repair under Sections 12-48 and 12-52 of the Monroe County
Code of Ordinances. The incidental sale of parts necessary for
repair of such items shall not change the basic character of such
service orientated businesses,
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
