RESOLUTION NO. 195-1984
A RESOLUTION APPROVING WITH CONDITIONS THE
DREDGE AND FILL APPLICATION OF LLOYD A. GOOD,
JR. IN SECTION C, AN EXTENSION OF SUGARLOAF
SHORES SUBDIVISION, LOCATED IN SECTION 11,
TOWNSHIP 67 SOUTH, RANGE 27 EAST, SUGARLOAF
KEY, FLORIDA.
WHEREAS, Lloyd A. Good, Jr. has filed an application with
Monroe County for a Dredge and Filling Permit on certain lands
located in Section C, an extension of Sugarloaf Shores Subdivi-
sion, located in Section in Section 11, Township 67 South, Range
27 East, Sugarloaf Key, Monroe County, Florida, and
WHEREAS, sketches and diagrams of the aforesaid proposed
dredging and filling on such lands is filed with the Zoning
Department of Monroe County, Florida, and
WHEREAS, extensive discussion was heard by the County
Commission of Monroe County, Florida, both for and against said
permit, and
WHEREAS, more than one hundred (100) letters of residents on
Sugarloaf Key were filed with the Clerk expressing their agree-
ment to such permit application, and
WHEREAS, certain biological findings and opinions were shown
in the record from the County biologist and others, and
WHEREAS, the County Commission reached the conclusion that
the area to be dredged and filled was an exception to the
Shoreline Protection Zone, and wherefore, certain conditions
moved into the record to be complied with by Mr. Lloyd A. Good,
Jr. as conditions precedent to the actual dredging and filling on
said land, now, therefore,
BE IT RESOLVED BY THE MAYOR AND COUNTY COMMISSION OF MONROE
COUNTY, FLORIDA, that:
1. The permit, as requested, shall be issued contingent
upon the filing of an amendment to the plat showing the proposed
changed.
2. That the amendment to the plat must be approved by the
County Commission prior to any dredging or filling being done on
said property.
3. No land clearing will be permitted or allowed outside
the areas designated for dredging, filling or road construction
as shown on the permit drawings.
4. Before the issuance of construction permits, the areas
designated on the drawings for dredging, filling or road
construction shall be staked on-site by a registered land
surveyor and reviewed for correctness by the County Biologist.
5. The developer will work in unison with the County
Biologist to preserve the Cinnecord (Acacia Choriophy11a) Tree.
6. The developer shall comply with the requirements of the
Department of Environmental Regulation as regards to the sewage
treatment plant
PASSED AND ADOPTED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, at a regular meeting of said Board held
on the 13th day of July, A.D. 1984.
