ING THE MAYOR TO EXECUTE A DEDICATION OF TH~~
STOCK ISLAND PROPERTY PURCHASED FOR A PUBIJ~-<
PARK AND TO AUTHORIZE THE CLERK TO RECGRlb r-

WHEREAS, Monroe County has purchased proper~1 on
Island to be used as a public park; and
WHEREAS, the County Commission has, by resolution, named

said park Benjamin Bernstein Park; and
WHEREAS, funding from the Florida Recreational Development
Assistance program and the Land and Water Conservation Fund
Program was used in the purchase of said property; and
WHEREAS, the Florida Administrative Code requires property
purchased with such funding to be dedicated in perpetuity as a
park; now, therefore
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, as follows:
Section 1.
That the Mayor execute a form to be entitled
Dedication of Land whereby said property is dedicated in
perpetuity for recreational purposes.
Section 2.
That upon the execution of said document, the
Clerk of Court record the document in the Official Records of the
County.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the 20th
day of

DEDICATION OF LAND
THIS DEDICATION OF LAND, made and executed this 02. O-th day
of :Januarv , 1993, by the BOARD OF COUNTY COMMISSION-
I
ERS OF MONROE COUNTY, a subdivision of the State of Florida, and
having its official post office address as c/o Clerk of Circuit
Court, 500 Whitehead Street, Key West, FL 33040, hereinafter
called the Grantor, in consideration of funding received from the
Florida Recreational Development Assistance Program, does dedi-
cate in perpetuity as an outdoor recreation site for the use and
benefit of the public, as required by Florida Administrative Code
Chapter 16D-5, those premises, situated in Monroe County and
described in Exhibit A, attached hereto and incorporated herein
by reference, which description is recorded at Monroe County
Official Records Book 1230, pages 1627 through 1634, as the
Warranty Deed whereby said property was acquired by the Grantor.
IN WITNESS WHEREOF, the Grantor has caused these presents to
be executed in its name by its Board of County Commissioners
acting by the Chairman or Vice-Chairman of said Board, the day
and year aforesaid.

EXHIBIT "A"
Lots 1, 2, 3, 4 and 5, Block 57, "George L. McDonalds
Plat of Part of stock Island", less the Westerly eight
feet (8') of Lot 1 and less the Easterly thirty feet (30)
of Lot 5, according to the plat thereof as recorded in
Plat Book 1, Page 55, of the Public Records of Monroe
County, Florida.
ALSO
A parcel of submerged land lying South of said Block 57,
more particularly described as follows: Commencing at
the Northwest corner of Lot 1, Block 57, Maloney's Plat
of Stock Island, according to the plat thereof, as
recorded in Public Records of Monroe County, Florida, in
Plat Book 1, Page 55, run South along the Easterly right
of way line of Fifth Street according to the
aforementioned plat a distance of 200 feet, more or less
to the shorel ine; thence meander the shore 1 ine in an
Easterly direction 8 feet, more or less, to the Point of
Beginning, said Point of Beginning being 8.00 feet
Easterly of as measured at right angles to the Easterly
Right of Way line of Fifth Street, according to the
aforementioned record plat, if extended Southerly; thence
run South along a line 8.00 feet distance from and
parallel to the Easterly Right of Way. line of Fifth
Street, if extended, for a distance of 1160 feet more or
less to a point; thence deflection 90 degrees to the left
run 310.27 feet; thence deflection 83 degrees 561 to the
left run Northeasterly along the Southwesterly extension
of the Easterly line of Lot 5, Block 57 of the
aforementioned plat of a distance of 1060 feet, more or
less to the shoreline; thence meander the shoreline in
a Westerly direction for a distance of 480 feet, more or
less, back to the Point of Beginning less that portion
sold to Stock Island utility Company by Warranty Deed
recorded in Official Records Book 866, Pages 2446-2450,
of the Public Records of Monroe County, Florida.
