RESOLUTION NO. 249-1984
A RESOLUTION REQUESTING THE STATE OF FLORIDA
DEPARTMENT OF TRANSPORTATION TO GRANT PERMIS-
SION TO MONROE COUNTY TO USE THE MEDIAN STRIP
ON U. S. NO. liS. R. 5 BETWEEN JEWFISH CREEK
AND TAVERNIER IN MONROE COUNTY, FLORIDA, FOR
THE PURPOSE OF HIGHWAY BEAUTIFICATION,
AUTHORIZING THE CLERK TO FORWARD A COpy OF
THIS RESOLUTION TO THE DEPARTMENT OF
TRANSPORTATION, AND AUTHORIZING THE CHAIRMAN
TO EXECUTE AN INTERLOCAL AGREEMENT WITH THE
DEPARTMENT OF TRANSPORTATION FOR THIS
USAGE.
WHEREAS, the State of Florida Department of Transportation
and the Board of County Commissioners of Monroe County, Florida,
have legal authority pursuant to Section 339.24, Florida Stat-
utes, to undertake actions in conservation of natural roadside
growths and scenery and in furtherance of the beautification of
roads by the restoration, planting, replanting, seeding, and
re-seeding of grasses, plants, shrubs, rootstocks, or trees, and
the maintenance of the same along roads within Monroe County,
Florida, and
WHEREAS, expenditures for such purposes have been declared
by the Legislature to be proper expenditures for highway con-
struction and maintenance, and
WHEREAS, the Board of County Commissioners of Monroe County,
Florida, is desirous of obtaining permission from the State of
Florida Department of Transportation to utilize the median along
U. S. liS. R. 5 between Jewfish Creek and Tavernier in Monroe
County, Florida, for the planting and maintenance of grass,
shrubs, trees, and other vegetation, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, as follows:
1. That the State of Florida Department of Transportation
is hereby requested to authorize and to grant permission to
Monroe County to use the median along U. S. liS. R. 5 between
Jewfish Creek and Tavernier in Monroe County, Florida, for
highway beautification purposes, more particularly described as
the planting and maintenance of grasses, shrubs, trees, and other
vegetative species.
2. That the Clerk of said Board be and is hereby directed
to forward a certified copy of this resolution to the State of
Florida Department of Transportation for appropriate action.
3. That in the event the State of Florida Department of
Transportation agrees to grant this request, the Board hereby
approves and authorizes the Mayor/Chairman to execute an
Interlocal Agreement with the Department of Transportation for
such usage, said Interlocal Agreement to be drafted by the County
Attorney.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida at a regular meeting of said Board held on
the 7th day of September, A. D. 1984.
