RESOLUTION NO. 258-1984
A RESOLUTION REQUESTING THE LEGISLATURE TO
RE-ENACT THOSE PROVISIONS OF CHAPTER 336,
FLORIDA STATUTES (1983), PROVIDING FOR THE
CREATION OF SPECIAL TAXING DISTRICTS FOR THE
PURPOSE OF ROAD AND BRIDGE CONSTRUCTION AND
IMPROVEMENT.
WHEREAS, within Chapter 336, Florida Statutes (1983), there
existed provisions for the creation, existence and operation of
special tax road districts, county special road and bridge
districts, and special road, bridge and ferry districts,
Sections 336.15,
et seq. ,
Sections 336.28,
et seq. ,
and
Sections 336.37, et seq., respectively, and
WHEREAS, the Legislature enacted during its 1984 session
Chapter 84-309, Laws of Florida (Senate Bill 352), re-writing the
Transportation Code, and by the enactment of Chapter 84-309,
above, repealed those provisions within Chapter 336, above,
pertaining to special tax road districts, county special road and
bridge districts, and special road, bridge, and ferry districts,
cited above, and
WHEREAS, it is the Board's understanding that the reason for
the deletion of these provisions from the Transportation Code was
that the drafters of the legislation were led to believe that
such districts were not currently being brought into existence
and that such provisions of law were outdated and antiquated and
were no longer used, and
WHEREAS, in Monroe County such special taxing districts are
in existence and more such districts will be required to be
created in Monroe County in the future, and
WHEREAS, the provisions of Chapter 336, above, pertaining to
such districts are currently and will be in the future in use in
Monroe County, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, that the Board does hereby request that
the Legislature take action during the next Legislative Session
to have these provisions re-enacted,
BE IT FURTHER RESOLVED BY SAID BOARD that the Clerk of this
Board is hereby directed to forward a certified copy of this
Resolution to the President of the Florida Senate and to the
Speaker of the Florida House of Representatives and to the
Honorable Larry Plummer and to the Honorable Joe Allen.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the 7th day of September, A.D. 1984.
