Resolution 269-1984 RESOLUTION NO. 269-1984 A RESOLUTION AUTHORIZING THE CHAIRMAN OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, TO EXECUTE AN INTERLOCAL AGREEMENT BY AND BETWEEN MONROE COUNTY, FLORIDA, AND THE KEY WEST HOUS ING AUTHORITY FOR THE USE OF PERSONNEL AND FACILITIES IN CONNECTION WITH ANIMAL CONTROL. BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that: The Mayor and Chairman of the Board of County Commissioners of Monroe County, Florida, be and is hereby authorized to execute an Interlocal Agreement by and between Monroe County, Florida, and the Key West Housing Authority, a copy of which is attached hereto, for the use on certain days of County facilities and personnel by the Key West Housing Authority in connection with animal control in and around its housing projects. FlY K~ INTERLOCAL AGREEMENT vffiEREAS, Monroe County cuyrently o~~s and operates the Nonroe County Animal Shelter - Key West Facility on Junior College Road, Stock Island, Florida, and in connection with its animal cor-trol program operates and maintains trucks specifically designed for the collection and transportation of animals and employs personnel, and WHEREAS, the Key West Housing Authority has authority to acquire and operate housing projects and LO maintain the same and to provide services in connection with the housing projects or to the occupants thereof and to investigate into the living, dwell- ing and housing conditions of the tenants of such projects and to investigate into the means and methods of improving such conditions and to cooperate wiLh the County in action taking co alleviate problems relating to the living, dwelling and housing conditions of the tenants in its projects, and WHEREAS, the Key West Housing Authority has discovereci a problem ~ith stray animals or animals running at large within its projects, and vlHEREAS, bOLh Nonroe County and the Key Hest Housing Authority have power relating to and responsibilities for animal control and animal shelter which pm>7ers the parties wish to jointly exercise, now, therefore, Monroe County and the Key West Housing Authority do hereby enter into this Interlocal Agreement under the laws of Florida this day of September, 1984, in the manner following: 1. Nonroe County will continue to operate an animal control facility. 2. Monroe County will permit the Key West Housing Authority to utilize its trucks and personnel for the pick-up, collection, and transportation of stray animals or animals running at large in and around housing projects. Such usage by the Key West Housing Authority shall be limited to Saturdays and Sundays only. 3. During such time as the trucks may be in the possession, either actual or constructive, of the Key WesL Housing Authority, the Key West Housing Authority shall keep and maintain the same in good and serviceable working order and shall be fully responsible and liable for any and all damage to the trucks or to any person or property arising out or the operation of the trucks. 4. During such time as any County personnel are working in the furtherance or the purposes of this Interlocal Agreement to assist the Key West Housing Authority in the collection, transportation, and housing of stray animals or animals running at large in and around housing projects, the Key West Housing Authority shall be fully responsible for the safety of such personnel and shall be fully liable and responsible for the actions of such personnel. 5. The Key West Housing Authority will compensate such personnel as are employed and utilized pursuant to this Interlocal Agreement as may be agreed between such personnel and the Key West Housing Authority. 6. Monroe County specifically authorizes its employees 'who may work with the Key West Housing Authority pursuant to the terms of this Interlocal Agreement to engage in such other emplo:nT1ent. 7. The animals collected by the Key West Housing Authority pursuant to this Interlocal Agreement shall be transported to the Monroe County Animal Shelter - Key West facility on Junior College Road, Stock Island, Florida. For each animal transported and placed in such facility, the Key West Housing Authority will pay to Monroe County the sum of Ten Dollars ($10.00). 8. The Key West Housing Authority does hereby agree to indemnify Monroe County, its officers, agents, and employees, for any and all claims of any sort whatsoever that may arise from the operation of the animal control program contemplated by this Int~rloca: Agreement. In this respect, the Key West Housing Authority does agree to hold harmless and to assume any and all responsibility for any claims, damages, or liabilities of any sort whatsoever resulting from the use of the County's trucks, the employment of County personnel, and the operation of the animal control program contemplated herein. The Key West Housing 2 Authority agrees to defend and to pay any and all costs incurred in connection with such defense including attorneys fees, costs of Court, and all such expenses relating to any such claims, damages, or liabilities, should the same occur. In the event liability insurance is carried by the Key West Housing Authority, Monroe County shall be shown thereon as a co-insured and a copy of said policy shall be forthwith made available to the County Administrator so reflecting. IN WITNESS WHEREOF, the parties hereto have caused this agreement to be executed by their duly authorized officials this day of September, 1984.
