RESOLUTION NO. 281_1984
RESOLUTION APPROVING AGREEMENTS MADE AND
RECORDED IN THE MINUTES OF THE MEETING OF THE
COUNTY COMMISSION OF MONROE COUNTY ON SEPTEM-
BER 21, 1984, AND DIRECTING THE MAYOR TO
EXECUTE AN AGREEMENT IN ACCORD WITH THE
CONTENTS HEREOF.
WHEREAS, the representatives of the Port Bougainville/Garden
Cove Major Developments have reached an understanding with regard
to the handling of certain public services and facilities for the
area described herein, specifically police protection, and
WHEREAS, these understandings have been accomplished between
the Board of County Commissioners of Monroe County and the
representatives of Port Bougainville/Garden Cove complex and will
be the subject of an agreement entered into and executed by both
the representatives of Port Bougainville/Garden Cove complex and
the County, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, that the understanding presented to the
Commission on behalf of the Port Bougainville/Garden Cove Major
Developments and the Board of County Commissioners of Monroe
County has been fully described to the Commission and has been
approved by the Monroe County Commission as follows:
1. Port Bougainville/Garden Cove agrees to
build-to-suit a police substation as part of the
3500 square foot government facilities building to
be constructed in Garden Cove; and to provide and
make available radio communications to the
Sheriff's Department through the Port Bougainville
Communications Center.
2. Port Bougainville/Garden Cove agrees to execute a
covenant running with the land to the effect that
within six (6) months of receipt of written notice
of the adoption by Monroe County of a plan or
policy setting a standard or providing for payment
by developers of fair share contribution for
police protection necessary to serve the
population generated by new residential
developments, that Port Bougainville/Garden Cove
will provide their fair share contributions based
upon said adopted standard for such services.
BE IT FURTHER RESOLVED BY SAID BOARD that the agreement
authorized herein will be put into contract form and the Mayor of
Monroe County, Florida, is hereby authorized to execute the same.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the 21st day of September, A.D. 1984.
