RESOLUTION NO. 320-1984
RESOLUTION REVERSING THE DECISION OF THE
ZONING ~OARD OF MONROE COUNTY, FLORIDA,
WITHOUT PREJUDICE, AND APPROVING THE REQUEST
OF DAVID LEO COOPER AND SAMUEL COOPER TO
REVERSE THE DECISION OF THE ZONING ~OARD OF
MONROE COUNTY, FLORIDA, DENYING A CHANGE OF
ZONING FROM GU TO ~U-2-T.
WHEREAS, on July 26, 1984, the Zoning ~oard of Monroe
County, Florida, denied the request for a change of zoning from
GU to ~U-2-T on the following described property:
Lots 11, 12, and 13, Square 4 of Kinercha Subdivision,
as recorded in Plat ~ook 1, Page 74, and located in
Section 26, Township 66 South, Range 29 East, ~ig Pine
Key, Monroe County, Florida.
WHEREAS, David Leo Cooper and Samuel Cooper has duly
appealed said decision to the ~oard of County Commissioners of
Monroe County, Florida, sitting as the ~oard of Appeals, and the
~oard having reviewed the transcript of the July 26, 1984
hearing, having cons idered the argument of all parties present
wishing to speak on the matter, and all premises considered, now,
therefore,
~E IT RESOLVED ~Y THE ~OARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, sitting as the ~OARD OF APPEALS, as
follows:
1. That the July 26, 1984 decision of the ~oard of County
Commissioners of Monroe County, Florida, sitting as the ~oard of
Appeals, denying the request of David Leo Cooper and Samuel
Cooper be, and the same is hereby reversed.
2. That said David Leo Cooper and Samuel Cooper, be, and
they are hereby granted a reversal of the decision of the Zoning
~oard of Monroe County, Florida, denying their request for a
change of zoning from GU to ~U-2-T on the above-described
property.
3. That the Clerk is hereby directed to make available to
the Field Representative of the Department of Community Affairs a

certified copy of this resolution certified mail to said Field
Representative, Post Office 'Box 990, Key West, Florida 33041,
return receipt requested.
PASSED AND ADOPTED by the 'Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said 'Board held
