T"I ;;0 I':~.:) N ~ N ,.-'''; ~ '1 c-; 0 C) ..... ;J U1 WHEREAS, prior to the adoption of the current Monroe County Land Use Plan, the property described as Lot I, Block I, Largo Beach Subdivision, Key Largo, fell into a Commercial zoning desig- nation; and WHEREAS, the current Monroe County Land Use Plan, when adopt- ed in 1986, changed the zoning of this parcel to Improved Subdivi- sion (IS), a residential designation; and WHEREAS, the permit holder applied during the first round of amendments to the Plan in 1987 to have such zoning returned to its original Commercial designation; and WHEREAS, the Planning Commission and the Board of County Commissioners at that time approved said zoning change back to the Commercial designation; and WHEREAS, the Florida Department of Community Affairs rejected the recommendations of staff, the Director of Planning, and the Building Official of Monroe County, and disallowed the return to the Commercial designation; and WHEREAS, the applicant has complied with regulations govern- ing the IS zoning, and is currently constructing a single family home on the site; and WHEREAS, a review of the proposed Future Land Use Maps (FLUMs) has revealed that the FLUM designation for the property in question will allow commercial development there; and WHEREAS, the applicant has requested that the Board of County Commissioners authorize the tolling of Permit No. 91-3-4456 for a period of time sufficient for his request for rezoning to the Commercial designation to be processed, which would then make his land use designation consistent with the proposed FLUM; NOW THERE- FORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA THAT: The Board hereby directs the Building Department to toll Permit No. 91-3-4456 until such time as the Comprehensive Plan Year 2010 has been adopted, and a request for rezoning to the Commercial designation for Lot 1, Block 1, Largo Beach, has been processed. The Clerk of the Board is hereby directed to forward one (1) certified copy of this Resolution to the Division of Growth Management. PASSED AND ADOPTED by the Board of County Commissioners of Monroe County, Florida, at a regular meeting of said Board held on the 9th day of February, A.D., 1993.
