RESOLUTION NO. 332 -1984
RESOLUTION DIRECTED TO THE STATE OF FLORIDA
AND ITS VARIOUS AGENCIES, INCLUDING THE
DEPARTMENT OF COMMUNITY AFFAIRS, REQUESTING
RECOGNITION OF CERTAIN OBLIGATIONS AS A
RESULT OF THE PROSPECTIVE PASSAGE OF A LAND
USE MAP, LAND USE PLAN AND ALL ATTENDANT
REQUIRED DOCUMENTATION FOR MONROE COUNTY,
FLORIDA.
WHEREAS, the County Commission of Monroe County is now in
the process of holding public hearings for the purpose of the
adoption of a Land Use Map, a Comprehensive Land Use Plan and all
attendant documentation for the purpose of developing a land
inventory and description of the various uses of that land as
will be set forth in enacted documents of the Commission, and
WHEREAS, it is probable that certain losses and exposures
shall devolve upon the County because of these enactments, and
WHEREAS, this Resolution shall become part of and shall be
added to any Land Use Plans adopted by the County Commission now
being considered.
WHEREAS, the development of the Comprehensive Land Use PIan,
the Land Use Map and all attendant documentation has been caused
to a major extent by the adoption by the State of Florida of the
updated Guiding Principles of Growth and Development, the revised
edition thereof having not been officially approved by Monroe
County at this time, and
WHEREAS, because of the adoption by the State of Florida of
the aforesaid Guiding Principles of Growth and Development great
expense, great losses and the expenditures of defending legal
actions of all sorts are entirely probable, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, as follows:
1. That the State of Florida be called on by this resolu-
tion to indemnify and hold harmless Monroe County from any
10sses, choses in action, liabilities, and exposures that are
created against Monroe County because of the adoption of any plan
or scenario now being considered by the Monroe County Commission
which is being done with the anticipation of development a Land
Use Map, a Comprehensive Land Use Plan and all necessary atten-
dant documents thereto.
That this indemnification and hold
harmless understanding shall be to any and all damages that may
be suffered through any type of legal action taken against Monroe
County and shall entail the furnishing of defenses to any such
actions regardless of what court or body in which it is lodged
and also shall entail and incorporate all expenses and costs
involved in any such contest.
2. That in resolving this matter as is herein reflected,
the Monroe County Commission expressly states that it has not
adopted the revised Guiding Principles of Growth and Development
and that the same has been initiated and enacted by the State
Cabinet sitting as the Land and Water Adjudicatory Commission.
The reference to the same herein made is the main cause for
having this resolution enacted,
3. That the Clerk of said Board is hereby directed to send
certified copies of this resolution to all members of the Land
and Water Adjudicatory Commission, the Secretary of State, the
Department of Community Affairs, Senator Larry Plummer, and
Representative Joe Allen.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the 16th day of November, A.D. 1984.
