RESOLUTION NO. 334-1984
RESOLUTION REVERSING THE DECISION OF THE
ZONING BOARD OF MONROE COUNTY, FLORIDA,
WITHOUT PREJUDICE, AND APPROVING THE REQUEST
OF STACEY L. HARNISH TO REVERSE THE DECISION
OF THE ZONING BOARD OF MONROE COUNTY,
FLORIDA, DENYING A CHANGE OF ZONING FROM BU-2
WITH A BU-2E TO BU-2 WITH A BU-2E AND BU-2C.
WHEREAS, on August 31, 1984, the Zoning Board of Monroe
County, Florida, denied the request for a change of zoning from
BU-2 with a BU-2E to BU-2 with a BU-2E and BU-2C on the following
described property:
Lots 8 throught 12 and a part of Lot 13, Square 28 of
Maloney's Subdivision, as recorded in Plat Book 1, Page
55, and located in Section 35, Township 67 South, Range
25 East, Stock Island, Monroe County, Florida.
WHEREAS, Stacey L. Harnish has duly appealed said decision
to the Board of County Commissioners of Monroe County, Florida,
sitting as the Board of Appeals, and the Board having reviewed
the transcript of the August 31, 1984 hearing, having considered
the argument of all parties present wishing to speak on the
matter, and all premises considered, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, sitting as the BOARD OF APPEALS, as
follows:
1. That the August 31, 1984 decision of the Zoning Board of
Monroe County, Florida, denying the request of Stacey L. Harnish
be, and the same is hereby reversed.
2. That said Stacey L. Harnish, be, and he is hereby
granted a reversal of the decision of the Zoning Board of Monroe
County, Florida, denying his request for a change of zoning from
BU-2 with a BU-2E to BU-2 with a BU-2E and Bu-2C on the
above-described property.
3. That the Clerk is hereby directed to make available to
the Field Representative of the Department of Community Affairs a
certified copy of this resolution certified mail to said Field
Representative, Post Office Box 990, Key West, Florida 33041,
return receipt requested.
PASSED AND ADOPTED by the ~oard of County Commissioners of
Monroe County, Florida, at a regular meeting of said ~oard held
on the 16th day of November, A.D. 1984.
