RESOLUTION NO. 403-1984
RESOLUTION REVERSING THE DECISION OF THE
ZONING ~OARD OF MONROE COUNTY, FLORIDA,
WITHOUT PREJUDICE, AND APPROVING THE REQUEST
OF JOSEPH L. CATES, JR. TO REVERSE THE
DECISION OF THE ZONING ~OARD OF MONROE
COUNTY, FLORIDA, APPROVING THE REQUEST OF
HENRY ~. HAMILTON FOR A CHANGE OF ZONING FROM
GU-2 TO ~U-2R.
WHEREAS, on August 31, 1984, the Zoning ~oard of Monroe
County, Florida, approved the request for a change of zoning from
GU-2 to ~U-2R on the following described property:
a tract of land in a Part of Government Lot 2, Section
29, Township 66 South, Range 28 East, Cudjoe Key,
Monroe County, Florida.
WHEREAS, Joseph L. Cates, Jr. has duly appealed said
decision to the ~oard of County Commissioners of Monroe County,
Florida, sitting as the ~oard of Appeals, and the ~oard having
reviewed the transcript of the August 31, 1984 hearing, having
considered the argument of all parties present wishing to speak
on the matter, and all premises considered, now, therefore,
~E IT RESOLVED ~y THE ~OARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, sitting as the ~OARD OF APPEALS, as
follows:
1. That the August 31, 1984 decision of the Zoning ~oard of
Monroe County, Florida, approving the request of Henry ~.
Hamilton be, and the same is hereby reversed.
2. That said Joseph L. Cates, Jr. be, and he is hereby
granted a reversal of the decision of the Zoning ~oard of Monroe
County, Florida, approving the request of Henry ~. Hamilton for a
change of zoning from GU-2 to ~U-2R on the above-described
property.
3. That the Clerk is hereby directed to make available to
the Field Representative of the Department of Community Affairs a
certified copy of this resolution certified mail to said Field
Representative, Post Office ~ox 990, Key West, Florida 33041,
return receipt requested.
PASSED AND ADOPTED by the ~oard of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
