VLORlDA, has received an application from lnst. of Delphinid
Research LTD.
, and
~'lHEREAS, in compliance with State:-:!tatute , it is necessary
as part of the permitting procedrue to read the following Biological
Assessment into the Record, as follows:
The applicant proposes the stabilization and development of a
canal shoreline and an open water shoFeline bordering a perimeter
channel to provide private boat mooring and shoreline protection.
More specifically, 000 lineal feet of concrete walkway will be
constructed along the canal shoreline, 180 lineal feet of riprap
(12 feet wide) will be deposited along the open water shoreline,
with a 7 foot wide dock constructed adjacent to and slightly
waterward of the riprap and an additional 120 lineal feet of dock
will be constructed along the offshore perimeter channel dropoff,'
so as to create an open water U-shaped basin. Additionally, a
20' x 40' boat ramp will be excavated near the terminal end of
the above mentioned canal. Excavation will be by backhoe and
hand.
The rinrap will be placed on a 3.1 s lope out to the ~~L"T line on
the open water shoreline. The canal shoreline will be cut back
about 10 feet with a backhoe and lined with filter cloth down
to MSL. ~iprap would then be placed over the filter cloth with
a concrete walk constructed out to the edge of the canal drop.
The top of this walk would be slightly above HHW with concrete
stairs laid on top of the riprap leading to the top of the em-
bankment.
The boat ramp would involve the removal of 65 cubic yards, most
of vlhich would be above I~H~'l, although the waterward 17 feet would
be excavated below ~mT\T. The sides of the ramp would be riprapned
on a 4.1 slope.
A total of ?40 cubic yards of riprap would be deposited for the
entire project, of which, 200 would be landward of ~~HW. Of this
total, 115 cubic yards would be placed along the open water shore-
line.
Pilings for the dock will be augered from a barge. Turbidity
screens will be utilized where necessary.
The project site is located on the western shoreline of Big Pine
Key bordering Pine Channel, which connects the Gulf with the
Atlantic in the Lower Keys. U.S. #1 is located immediately to the
south of this site and a new bridge is presently under construction
here. To the north is Pine Channel Estates Subcivision, a canal
oriented residential community. The canal and offshore perimeter
channel bordering the applicant's property are, in fact, a part of
this subdivision canal system. The applicant's upland has been
zoned for business by the county.
Pine Channel is moderately shallow, with excellent water quality
and a predominance of seagrasses over its bottom.

The canal and perimeter channel are extremely deep, although
water quality is better than might be expected for a dead end
system due to an optimal orientation to dominant wind directions.
The applicant's property is primarily of an upland nature, drop-
ping sharply at the erosion line to form a 10-15 foot wide open-
water littoral shelf (0.5 feet wide along the canal), which then
drops into the channel or canal depths.
The open water littoral shelf presently supports a patchy and
somewhat stunted growth of red mangroves (Rhizophora m~ngle). The
substrate along this shelf is somewhat prohibitive to mangrove
growth due to its hard, rock limestone rubble characteristic.
Nearly all of the mangroves observed here were found in betwe8n
MV~ and ~'m\T.
Those species of organisms observed below MLW included green algaes
(Batophora sp. and Penicillus sp.), calcareolls a 1 gaes (Halimeda sp.),
red algaeR (Acanthophora sp.), anem0nes (Bartholomea sp,), starfish
(Echinaster sp.), barracud~ (Sphraena barracuda), schoolmaster
snapper (Lutjanus griseus), pinfish (Lagodon shomboides), jack
crevalle (Caranx hippos), and grunts (Haemulon sp.).
The canal shoreline is lined wjth Australian Pines (Casuarina
equisitifolia). The narrow submergent shelf here displays some
green algaes and very scattered sea grasses (Syringoduim filiformis).
Both the channel and the canal are boxcut dropping to unidentifiable
depths.
The outside or western edge of the perimeter channel, where dock
construction is to take place, supports a lush variety of turtle-
grass (Thallassia testudinum), Cuban shoalweed (Halodule wrightii),
and numerous algaes before dropping to greater depths.
Adverse impacts are expected to be minimal for this project, al-
though some concern exists over the amount of dock space and the
potential for water quality degradation from boat usage. Circula-
tion is good in this area and it is felt that any potential pollu-
tants would have a low residence time. A small number of small
mangroves will be lost along the open water shoreline, however,
the riprap put in its place should add stabilization to the
shoreline and provide a small amount of intertidal habitat.

INTRODUCTION
This application is to be reviewed by the Board of County
Co~missioners in accordance with Chapter 19-111 (a) (5) of the
Monroe County Code.
DISCUSSION
The applicant proposes the following activities on the subject
property.
1. Construct a 900 linear foot long by 5 foot wide walkway
along the man-made canal bordering the property on the
north. A 10 ft. ~ide area will be excavated from the
landward edge of the canal down to the caprock. Rip-
rap and filter fabric will be placed along the slope of
, this excavation for stahilization purposes. Steps will
be constructed from the upland to the aforementioned
concrete walkway. The walkway will be placed on the ex-
posed caprock.
Rip-rap will also be placed along 180 linear feet of Pine
Channel shoreline. The total amount of boulders required
will be 240 c.y. (200 c.y. of which will be placed above
Hl-IW) .

A boat ramp (40 ft long by 20 ft. wide) will be constructed
on the canal approximately 150 ft. from the canal opening to
Pine Channel. ~he boat ramp will result in the removal
of 65 c.y. of material including 17 c.y. below MHW.

A wooden L-shaped dock measuring 105 ft. parallel to the
shorelineJslightly waterward of the rip-rap) and 75 ft.
perpendicular to the shoreline will be constructed. The
dock will be 7 ft. wide.
4.
Also proposed is a rental jsales building to be located
on Lhe property.

Dear Lynn:
I wish to inform you that the seawall proposed along the
canal can be permitted at this time, but the dock in Pine Channel
cannot. The reason for this is that Monroe County considers such
structures accessory and as such cannot be built until such
time as a principle building or structure is constructed, (Monroe
County Code Chapter 19-132.1). Also, the future plans for the
upland may constitute a major development project.
You may wish to talk with Mr. Henry Weinkam, Director of
Building, Planning and Zoning, aboutlthis project at your
earliest convenience.

Dear Bob:
As per your request, this letter will serve to inform any interested
parties, for the purpose of procuring local approval, that the
comments I have submitted for the above referenced original appli-
cation have not significantly changed as a result of recently
submitted application modifications.
As I understand, the applicant's proposed boat ramp has been relocated
to the west along the canal and the 120 foot long open water dock
which extends in a north/south direction will be eliminated. The
associated impacts originally stated will be somewhat decreased, with
particular decreased emphasis on my initial concern over total dock
space and consequential water quality degradation potential from
boat usage.

Florida Statutes, for filling waterward of the existing mean/
ordinary high water line.

Commissioners/City Councilor their authorized permitting
authority: Section 253.124, Florida Statutes, states that the
county commission/city council ". . .shall have in hand the
(biological) report and findings thereof." It further states,
"The report shall be read into the record and duly considered
at the same meeting at which the board of county commissioners
or other authorized body takes final action on the application
for permit."

A. The applicant proposes the stabilization and developmeht'of a
canal shoreline and an open water shoreline bordering a perimeter
channel to provide privatebo~t mooring and shcreline protection.
More specifically. 900 lineal feet of concrete walkway will be
constructed along the canal shoreline, 180 lineal feet of riprap
(12 feet wide) will be deposited along the open water shoreline,
wi th a 7 foot wide dock .con::;tructed adj acent to _ and"s,light1y
waterward of the riprap and an additionaL 120 lineal feet of dock
will be constructed along the offshore perimeter channel dropoff.
so as to create an open,water U-shapped basin. Additionally, a
20' x 40' boat ramp will be excavated near the terminal end of
the above mentioned canal. Excavation will be by backhoe and
hand. '
The riprap will be placed on a 3:1 slope out to the MLW line on
the open water shoreline. The canal shoreline will be cut back
about 10 feet with a backhoe and lined with filter cloth down
to MSL. Riprap would then be placed over the filter cloth w~th
a concrete walk constructed .out to the edge of the canal drop.
The top of this walk would be slightly above MHW with concrete
stairs laid on top of the riprap leading to the top ...of the em-
bankmen t .
The boat ramp would involve the removal of 65 cubic yards, most
of which would be above MHW, although" the waterward 17 feet would
be excavated below MHW. The sides of the ramp would be riprapped
on a 4:1 slope.
A total of 240 cubic yards of riprap would be deposited for the
entire project, of which. 200 would be landward of MEW. Of this
total,. 115 cubic yards would be placed along the open water shore-
line.
Pilings for the dock will be augered from a barge~ Turbidity_
screens will be utilized where necessary.
B. The project site is located on the western shoreline of Big Pine
Key bordering Pine Channel, which connects the Gulf with the
Atlantic in the Lower Keys. U.S. #1 is located immediately to the
south of this site and a new bridge is presently under construction
here. To the north is Pine Channel Estates Subdivision, a canal
oriented residential community. The canal and offshore perimeter
channel bordering the applicant's property are, in fact. a part of
this subdivision canal system. The applicant's upland has been

zoned for business by the county.

Pine Channel is noderately shallow, with excellent water quality
and a predominance of seagrasses over its bottom.
The canal and perimeter channel are extremely deep, although
water quality is better than might be expected for a dead end
system due to an optimal orientation to dominant wind directions.
C. The applicant's property is primarily of an upland nature, drop-
ping sharply at the erosion line to form a 10-15 foot wide open-
water littoral shelf (0.5 feet wide along the canal), which then
drops into the channel or canal depths.
The open water littoral shelf presently._-support.s a patchy and
somewhat stunted grGlth of red mangroves"(Rhizophora mangle). The
substrate along this shelf is somewhat prohibitive to mangrove
growth due to its hard, rock limestone rubble characteristic.
Nearly all of the mangroves observed here were found in between
MLW and MHW.
Those species of organisms ,observed below MLW inc~uded green algaes
(Bato1hora sp and Penicillus sp.), calcareous algaes (Halimedasp.),
red a gaes (Acanthophorasp.), anemones (Bartholomea sp.), starfish
(Echinaster sp.), barracuda (?~Faena barracuda), schoolmaster
snapper' (Lutjanus ~riseus), linfish. I,Lagodon rhomboides), jack
crevalle 1Caranx h1PPos), an grunts (Haemu1on sp.).
The canal shoreline is lined with Australian Pines (Casuarina
equisitifolia). The narrow submergent shelf here displays some
green algaes and very scattered sea grasses -CSyx'itig6dliiIIifiliformis).
.
Both the channel and the canal are boxcut dropping to unidentifiable
depths.
The outside or western edge of the perimeter channel, where dock
construction is to take place, supports a lush variety of turtle-
grass (Tha1assia testudinum), Cuban shoalweed (Ha1odule wrightii),
and numerous a1gaes before dropping to greater depths.

D. Adverse impacts are expected to be minimal for this project, al-
though some concern exists over the amount of dock space and the
potential for water quality degradation from boat usage. Circula-
tion is good in this area and it is felt that any potential pollu-
tants would have a lo\v residence time. A small number of small

mangroves will be lost along the open water shoreline, however,
the riprap put in its place should add stabilization to the
shoreline and provide a small amount of intertidal habitat.
