Resolution 169-1982 " ---,4 RESOLUTION NO. 169 1982 WHEREAS, the BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, has received an application from STEPHEN R, HYER and WHEREAS, in compliance with State Statute, it is necessary as part of the permitting procedure to read the following Biological Assessment into the Record, as follows: The applicant proposes to reclaim land lost due to erosion and to protect his shoreline from additional erosion, The goals will be achieved by filling a triangular shaped area of bay bottom along the applicant's existing shoreline. In total 1200~ sq. ft. (0,03+ A.) of wetlands, most of which is waterward of mean high water (MHw), will be filled. An estimated 200 cu, yds. of fill will be placed waterward of MHW to raise the elevation of the filled area to 3 feet above MHW. The shoreline created by the above ,described filling will be protec- ted from erosion by constructing a riprap revetment along its water- ward edge. The revetment will be constructed in two segments, one of 100 foot length and a second of 10 foot length for a total of 110~ feet of revetment, A 4000+ sq. ft. (0.092+ A,) area of transitional wetlands will be impounded by the filling. No description of the proposed construction techinques was provided in the application, however, the ready availability of upland supply routes suggest that they would be utilized exclusively, The project site is located in Toll Gate Shores subdivision at the west end of Lower Matecumbe Key, Toll Gate Shores is an residential subdivision with an estimated 75 percent of the available lots developed with single family residences. Many of the lots within the subdivision, front on Florida Bay. The lots which don't face the bay, have canal front water access. Florida Bay in the vicinity of the project is designated as Class III waters (Chapter 17-3,081, Florida Administrative Code). Toll Gate Shores subdivision was apparently created over 25 years ago by filling mangrove wetlands with material obtained from the subdivision's canals, The project site is bordered by existing single family residences on both the north and east sides, The property to the north of the site is protected from erosion by a seawall which is located 25+ feet waterward of the MHW line on the applicant's property. The shoreline on the property to the east has not been bulkheaded and has an area of fringing mang~ove trees up to 20 feet high, with water access provided by a piling supported dock. Florida Bay borders the project site on the west and south sides. A cul-de-sac at the end of Toll Gate Boulevard forms the northeast side of the applicant's property. The applicant's property is a wedge shaped residential lot of approximately 9000 sq, ft. (0.21+ A.) area. The landward most portion of the lot is vegetated by pioneer grasses, scrubs and ornamental trees and bushes. A 30 to 50 foot wide area of transi- tional wetland borders the property shoreline. Vegetation within the transitional wetlands consists of salt grass (Distichlis spicata), sea daisy (Borrichia sp,) and buttonwood trees (Concarpus erecta). Both the upland and transitional wetlands on the site appear to have been mowed periodically in the past, preventing the establishment of much large vegetation. At the shoreline a one foot high escarpment drops from the lot elevation to approximately MHW, Growing on the escarpment and just waterward of it along the western lot shoreline, are a few buttonwood trees, The trees in this area have been undermined by erosion to the point that several have fallen over. Along the southern pro- ject site shoreline a 15 to 20 foot wide zone of lush mixed red mangrove (Rhizophora mangle), white mangrove (Laguncularia racemosa) and black mangrove trees (Avicennia germinans) is found. The difference in shoreline vegetation on the west and south shore- line areas is apparently due to the difference in exposure to wave energy. The south, facing shore, is much more protected from attack by waves than the west, facing shoreline area. An area of unvegetated sand and marl extends for approximately 10 feet waterward of the MHW line on the west project shoreline, Beyond the unvegetated area of bare marl and sand a zone of Cuban shoalweed (Diplanthere wrightii) is found, The Cuban shoalweed grades into a predominantly turtlegrass bed (Thalassia testudinum) at a distance of 15 feet waterward of MHW at the north end of the shoreline and 30 feet waterward of MHW at the south end, Fauna observed with the proposed fill area consisted of star coral (Siderastrea radians), sponges, hermit crabs and american star-shell snails (Astraea tecta). Construction related activities can be expected to cause temporarily elevated levels of particulate organic compounds, dissolved organic compounds, dissolved organic compounds and turbidity in the waters near the project site. Correct utilization of silt screens should be able to reduce this impact to acceptable levels, The emergent (mangrove) wetlands along the project site shoreline will be partially eliminated by the proposed activity. The tran- sitional wetlands will be impounded and probably heavily scarified by the adjacent filling activities. With the elimination of the wetlands, their functions as sources of primary production, habitat and pollution filtration, will also be eliminated. Placement of riprap along the edge of the new fill will replace some of the habitat functions of the emergent wetlands, Filling the shallow seafloor adjacent to the applicant's land will permanently eliminate the area as a submergent wetland, Included in the loss will be the elimination of habitat, primary production and nursery ground functions, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that the above Biological Assessment has been read into the record and duly considered pursuant to Florida Statute 253.124 by the Board of County Commissioners of Monroe County, Florida, this 28th day of June 19 82 , at a regularly scheduled meeting. The trees in this area have been undermined by erosion to the point that several have fallen over. Along the southern pro- ject site shoreline a 15 to 20 foot wide zone of lush mixed red mangrove (Rhizophora mangle), white mangrove (Laguncularia racemosa and black mangrove trees (Avicennia germinans) is found. The difference in shoreline vegetation on the west and south shore 1 areas is apparently due to the difference in exposure to wave energ The south, facing shore, is much more protected from attack by waves than the west, facing shoreline area. An area of unvegetated sand and marl extends for approximately 10 feet waterward of the MHW line on the west project shoreline. Beyo the unvegetated area of bare marl and sand a zone of Cuban shoalwee (Di~lanthere wrightii) is found. The Cuban shoalweed grades into a pre ominantly turtlegrass bed (Tha1assia testudinum) at a distance of 15 feet waterward of MHW at the north end of the shoreline and 30 feet waterward of MHW at the south end. Fauna observed with the proposed fill area consisted of star coral (Siderastrea radians), sponges, hermit crabs and american star-shel snails (Astraea tecta). D. Construction related activities can be expected to cause temporaril elevated levels of particulate organic compounds, dissolved organic compounds, dissolved organic compounds and turbidity in the waters near the project site, Correct utilization of silt screens should be able to reduce this impact to acceptable levels. <' .. 1 HYER, STEPHEN R. 440517895 Monroe County - Lower ~Iatecumbe Page Four The emergent (mangrove) wetlands along the project site shoreline will be partially eliminated by the proposed activity. The tran- sitional wetlands will be impounded and probably heavily scarified by the adjacent filling activities. Witll the elimination of thc. wctlands, their functions as sources of primary production, habitat and pollution filtration, will also hc eliminated. Placement of riprap along the edge of the new fill will replace some of the habitat functions of the emergcnt wctlands. Filling the shallow seafloor adjacent to the applicant's land will permanently eliminate the area as a submergent wetland.
