RESOLUTION NO. 211 -1982
RESOLUTION REQUESTING THE SUPERVISOR OF ELECTIONS TO
CONDUCT A SPECIAL REFERENDu~ ELECTION ON NOVEMBER 2,
1982, IN MONROE COUNTY TO DETERlUNE WHETHER OR NOT
THE COUNTY SHALL UfPOSE A ONE-CENT (Ie;:) ADDITIONAL
TAX ON THE SALE OF HOTOR FUEL AND SPECIAL FUELS SOLD
IN THIS COUNTY AS PER THE PROVISIONS OF FLORIDA
STATUTE 336.021 k~D SETTING FORTH THE QUESTION AS IS
TO BE REFLECTED ON THE BALLOT.
WllliREAS, it has come to the attention of the Board of County
Commissioners of Monroe County, Florida, that Florida Statute
336.021(1) does provide for an additional one-cent (Ie;:) gas tax on
each and every gallon of motor fuel or special fuel sold in this
County, and
WHEREAS, the aforesaid statute does require a referendum of
the people of Monroe County before the same can be enforced, and
~~EREAS, the statute aforesaid requires the structuring of
a referendum for the same, and
WHEREAS, provision is made in said law for there to be partici-
pation by other municipalities within ~10nroe County, now, therefore,
BE IT RESOLVED BY THE BOAPJ) OF COUNTY C0M11ISSIONERS OF MONROE
COUNTY, FLORIDA, as follows:
1. That a referendum be called in Monroe County under the
provisions of Florida Statute 336.021(1) for the purpose of holding
a public referendum to determine whether or not a tax of one-cent
(Ie;:) per gallon of motor fuel and special fuel sold in this County
shall be approved.
2. That, in as far as the State law provides the referendum
on this question, that the proposition to be inserted on the ballot
shall read as follows:
"SHALL AN ADDITIONAL ONE CENT (Ie;:)
TAX BE IMPOSED ON THE SALE OF
EVERY GALLON OF MOTOR FUEL AND
SPECIAL FUEL SOLD IN MONROE COUNTY
FOR A PERIOD OF TWO (2) YEARS FROM
THE DATE OF APPROVAL OF THE SM,IE?"

3. That upon approval by resolution of any of the munici-
palities in this County, and in accordance with Florida Statute
336.021, said city shall be a participant in said revenue sharing,
if approved, based on the fuel sold within said municipality.

4. That the tax imposed by this referendum, if passed, shall
last for a period no longer than two (2) years from its imposition,
it being provided that the commencement of said tax shall be on
the first day of the first month after said referendum has been con-
ducted.
5. That the Honorable William Freeman, Supervisor of Elections,
be and he is hereby requested to conduct a Special Referendum
Election on Tuesday, November 2, 1982, on the abovesaid question.
6. That the Clerk of said Board shall forthwith furnish a
certified copy of this Resolution to the Supervisor of Elections
and the Legal Department is hereby authorized to advertise said
referendum in the Key West Citizen, The Keynoter and The Reporter
in accordance with the requirements of law.
7. That as far as is practicable, taxes collected as pro-
vided herein shall be expended in the area where collected.
Passed and adopted by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the 9th day of August, A.D. 1982.
