Resolution 266-1982 RESOLUTION NO, 266-1982 RESOLUTION PROCLAIMING THE DESIRE OF MONROE COUNTY, FLORIDA, TO ACQUIRE FROM THE FLORIDA DEPARTMENT OF TRANSPORTATION A FORTY FOOT (40') STRIP OF EXISTING RIGHT-OF-WAY FOR SR-S (US-I), FROM APPROXIMATELY AVIATION BOULEVARD TO INDUSTRIAL AVENUE, MARATHON AIRPORT, MONROE COUNTY; ESTABLISHING THE NEED FOR SAME; SETTING GUIDELINES FOR THE ACQUISITION OF SAID RIGHT-OF-WAY, WHEREAS, the Board of County Commissioners of Monroe County, Florida is desirous of acquiring from the Florida Department of Transportation a forty foot (40') strip of existing right- of-way for SR-S (US-I), from approximately Aviation Boulevard to Industrial Avenue adjacent and contiguous to the Marathon Airport existing south property boundary, and WHEREAS, acquisition of same will permit Monroe County to optimize use of the present airport property for aeronautical purposes, and WHEREAS, this additional property would be utilized for future construction of an airport access road and parking area, and WHEREAS, supporting funds from the Federal Aviation Admini- stration and the Florida Department of Transportation may be made available under the Airport and Airway Improvement Act of 1982 for both land acquisition and construction, now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that 1, It is hereby set forth and proclaimed that the aforesaid Board of County Commissioners of Monroe County, Florida, acknow- ledges its desire to acquire from the Florida Department of Transportation a forty foot (40') strip of existing right-of-way for SR-S (US-I), from approximately Aviation Boulevard to Industrial Avenue adjacent and contiguous to the Marathon Airport existing south property boundary, That ln so doing it is the intent of this Board of County Commissioners to set forth that the aforesaid property is needed and necessary and desired by the citizenry of Monroe County, 2, In declaring the desire which is herein described before, the Board of County Commissioners of Monroe County, Florida, does pledge and utilize its fullest cooperation with the varIOUS agencies of the Federal Government and the State of Florida, particularly the Federal Aviation Administration and the Florida Department of Transportation, in the acquisition of the aforesaid property. 3, It is understood and agreed that as a condition for conveyance of the aforesaid property to Monroe County by the Florida Department of Transportation, that Monroe County will participate in the administrative costs associated with this land acquisition, said costs being eligible for both federal and state participation, and, further, in exchange for conveyance of the aforesaid property to Monroe County by the Florida Department of Transportation, Monroe County will grant the Florida Department of Transportation the right to construct drainage retention areas at and within the east and west ends of the airport property boundaries, together with a perpetual easement for maintenance of same. 4. Nothing herein shall conflict with Monroe County's assurances and/or obligations under its past, present or future Grant Agreements with the V.S, Department of Transportation, Federal Aviation Administration for the development of Monroe County's airports. Passed and adopted by the Board of County Commissioners of Monroe County, Florida, at a regular meeting of said Board held on the 18th day of October, A,D, 1982.
