Resolution 314-1982 Louis l-"'--ye Social ~__,ices Department . .---..- RESOLUTION NO. 314 -1982 RESOLUTION AUTHORIZING THE CHAIRMAN OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, TO EXECUTE AN AGREEMENT BY AND BETWEEN THE COUNTY OF MONROE, STATE OF FLORIDA, AND DIANE B. TYREE, R.D., A NUTRITIONIST/CONSULTANT. BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, as follows: That the Chairman of the Board of County Commissioners of Monroe County, Florida, is hereby authorized to execute an Agree- ment by and between the County of Monroe, State of Florida, and Diane B. Tyree, R.D., a nutritionist/consultant, a copy of same being attached hereto. Passed and adopted by the Board of County Commissioners of Monroe County, Florida, at a regular meeting of said Board held on the 13th day of December, A.D. 1982. AGREEMENT THIS AGREEMENT, made and entered into this 22nd day of Novem- ber, 1982, by and between the BOARD OF COUNTY COMMISSIONERS OF MON- ROE COUNTY, FLORIDA, a body corporate and politic existing under the laws of the State of Florida, hereinafter called the SPONSOR, and DIANE B. TYREE, R.D., a nutritionist/consultant, whose mailing address is Box 215, Key Largo, Florida 33037, hereinafter called the CONTRACTOR. HITNESSETH HHEREAS, the SPONSOR desires to utilize the services of the CONTRACTOR for the purpose of providing nutrition consultation in the Older Americans Act, Title III-C, Nutrition Program in Monroe County and the CONTRACTOR is willing to provide for said services upon the terms and conditions of this Agreement, NOH, THEREFORE, the parties agree and undertake as follows: I The CONTRACTOR hereby agrees to furnish consultation services, in accordance with Attachment "A" of this Agreement and to be paid , $15.00 per hour for said services. II The SPONSOR agrees to reimburse the CONTRACTOR for consultation services according to the aforesaid schedule, payment to be made to the CONTRACTOR no more than thirty (30) days after receipt by the SPONSOR of the CONTRACTOR'S claim. Claims for reimbursement shall be rendered as promptly as practicable after the 10th day of each month. III If additional services are requested by the SPONSOR, the parties shall mutually negotiate for additional services including cost of providing same to be paid to the CONTRACTOR. IV The CONTRACTOR shall provide at least thirty (30) days of notice to terminate this AGREEMENT. V The obligations of the SPONSOR under this Agreement are subject to the availability of funds lawfully appropriated annually for its purpose by Monroe County, Florida, and on the availability of funds through contract or grant programs. VI This Agreement shall continue in effect to and including the 31st day of December, 1982, at which time the CONTRACTOR'S obligations hereunder shall cease, unless terminated sooner as provided for herein. -2- WITNESS WHEREOF, the parties hereto have executed this Agreement the date first above written.
