RESOLUTION APPROVING CHANGE ORDER NO. 2 AND CHANGE
ORDER NO.4 AMENDING THE CONTRACT BY AND BETWEEN
UPPER KEYS MARINE CONSTRUCTION, INC. AND MONROE
COUNTY, FLORIDA, COVERING DELETIONS AND ADDITIONS
TO SAID CONTRACT DUE TO THE DELAY OF THE FLORIDA
KEYS AQUEDUCT AUTHORITY IN AWARDING A WATER LINE
CONTRACT FOR THE INSTALLATION OF A NEW WATER LINE
ON THE PERMANENT COPA D'ORO BRIDGE.
WHEREAS, Monroe County, Florida, previously entered into a
contract with Upper Keys Marine Construction, Inc. for the
permanent replacement of Copa D'Oro Bridge, Monroe County,
Florida, and
WHEREAS, after the contract letting and during construction
it has been brought to the attention of the County Engineers,
Post, Buckley, Schuh & Jernigan, Inc., that said Contractor is
unable, through no fault of his, to complete said contract with
respect to pavement, pavement marking, installation of said
cement rip-rap, nor can he remove the Temporary Bridge (which has
the temporary water line on it), which is a necessity prior to
the restoration of private property due to a delay by the Florida
Keys Aqueduct Authority in authorizing the work necessary to
remove the water line from the Temporary Bridge, and to install a
new water line on the new Permanent Bridge, and
WHEREAS, Upper Keys Marine Construction, Inc. has issued
Change Order No. 2 and Change Order No.4 to cover the necessary
deletions and additions in order to complete said project and
submitted said Change Orders to the Board of County Commissioners
of Monroe County, Florida, for its approval, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, as follows:
1. That said Board of County Commissioners hereby approves
Change Order No.2 and Change Order No.4 to that certain con-
tract entered into by and between Monroe County, Florida, and
Upper Keys Marine Construction, Inc. for the permanent replace-
ment of Copa DIOro Bridge in Monroe County, Florida.
2. That said Board also approves and authorizes the
adjustment to be made in the Contract Price and Time as contained
in said Change Order No. 2 and Change Order 4.
Passed and adopted by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the 23rd day of November, A.D. 1983.

RE: Change Requests #2 and #4 for the Copa D'Oro Bridge Projects
• Dear Mr. Stickney:•
• Enclosed for your further processing is Change Order #2 (Project Number
401-002.14K, Copa D'Oro Permanent Bridge) and Change Order #4 (Project
Number 401-002.14J, Copa D'Oro Temporary Bridge).
These change orders are submitted together as a package, and represent a
no cost Transfer of Funds and work requirement from one contract to another
contract.
In general, the contractor is unable to complete Copa D'Oro Permanent
Bridge on schedule due to the delay in awarding a water line contract (for
installation of a new water line on the permanent Copa D'Oro Bridge) by the
Florida Keys Aqueduct Authority. We have therefore recommended that those
items in contract #401-002.14K, Copa D'Oro Permanent Bridge, that are
contingent upon the Aqueduct Authority Contract be deleted from the
Permanent Bridge Contract and added to the removal portion of the Temporary
Bridge Contract (#401-002.14J), and that. the Permanent Bridge Contract be
recorded as completed on schedule.
We have discussed the legality of this proposal for change of funding with
Mr. Proby and he is inclined to agree that it can be accomplished. We therefore
recommend that the Commission approve these changes as being in the best
interest of Monroe County.

REFERENCES AND BACKGROUND
Job Number 401-002.14J is a Monroe County Contract with Upper Keys Marine, for
the installation and subsequent removal (after completion of the Permanent Bridge) of
the Copa D'Oro (By-Pass) Bridge. Under this contract the FKAA installed a temporary
•• water line on the Temporary Bridge.
Job. Number 401-002.14K is a Monroe County Contract with Upper Keys Marine for the
construction of a Copa D'Oro Permanent Bridge, and the restoration of private
property after removal and return of the Temporary Bridge.
Job Number (unknown) is a contract awarded November 9, 1983, between the Florida
Keys Aqueduct Authority, and Upper Keys Marine Construction for the removal of the
temporary water line from the Temporary Copa D'Oro Bridge, and the installation of a
permanent water line on the Permanent Copa D'Oro Bridge.
NATURE OF THE CHANGE
Because of the delay by the Florida Keys Aqueduct Authority, in authorizing the work
necessary to remove the water line from the Temporary Bridge, and to install a new
water line on the new Permanent Bridge, the contractor is not able to complete his
contract in full for the construction of the Copa D'Oro Permanent Bridge by November
• 14, 1983.
The Permanent Bridge structure is complete. Until, however, the installation of the
new permanent water line on the new bridge is complete the contractor cannot
complete the contract with respect to pavement, pavement marking, installation of
sand cement rip-rap, nor can he remove the Temporary Bridge (which has the
temporary water line on it), .which is a necessity prior to the restoration of private
property.
To correct this situation, which is no fault of the contractor, Upper Keys Marine, the
contractor has recommended that the following items be deleted from Job #401-
002.14K, Contract for Construction of the Copa D'Oro Permanent Bridge, and added to
Job #401-002.14J, Contract for Construction and Removal of Copa D'Oro Temporary
(By-Pass) Bridge.

This proposal would allow the contractor to essentially complete his contract on the
permanent bridge which is now being held up by the late contract award by the Florida
Keys Aqueduct Authority and in addition would:
(A) Allow for the pavement of the new approach roadways after completion
of a portion of the water line installation, rather than paving it now, and
then cutting and patching it to install the water line when that contract is
finally put into operation. The plan would be to tap into the existing
water lines at each end of the bridge project, install the PVC portion of
• the new water line up to the bridge itself (where it becomes steel pipe)
and pave over this installed portion of the water line (see sketch).
(B) As an added incentive, the . contractor has agreed. to remove the
Temporary Bridge and return to the State prior to January 1, 1984, thus
saving the County the cost of an additional month's rent on the Temporary
Bridge. .
We recommend that these change orders be approved, and that the funds in the amount
of $7,627.60 be deleted from Job #401-002.14K, Copa D'Oro Permanent Bridge and
added to Job #401-002.14J, Copa D'Oro Temporary (By-Pass) Bridge.
It is anticipated that Contract 401-002.14K, Copa D'Oro Permanent Bridge would be
completed as far as possible by November 14, 1983 and that Contract 401-002.14J
would be completed no later than January 15, 1984.
