RESOLUTION NO. 107 -1993
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, OPPOSING HOUSE BILL 79 AND
REQUESTING THE MONROE COUNTY LEGISLATIVE DELEGATION TO
OPPOSE HOUSE BILL 79 AND ANY CHANGES IN THE SENTENCING ~
GUIDELINES OR RECLASSIFICATIONS OF CRIMES FROM FE~NIES ~

WHEREAS, the Florida Legislature has recently ~i;6h~dered J

House Bill 79 which will drastically change sentencing:gUi~~Il!les g

and result in the imprisonment of some felons in Co~ty ;ja~s, 0
by virtue of the provision which calls for "nons tate prison" for
felons scoring below 40 points; and
WHEREAS, the effect of this legislation will significantly
shift financial and other responsibilities for housing of
prisoners from the State penal system to the County, and
WHEREAS, Monroe County is currently under Federal Court
Order to alleviate jail overcrowding; and
WHEREAS, Monroe County has obligated 40 Million Dollars for
the purpose of building a new jail facility that is capable of
meeting its responsibilities for the next 10 years under the
existing system; and
WHEREAS, the implementation of House Bill 79 will result in
an immediate filling and overcrowing of Monroe County's new jail
facility
and will
necessitate
large
additional
capital
expenditures in the immediate future, and
WHEREAS the citizens and taxpayers of Monroe County are
already overburdened with the costs of its new jail;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA, as follows:
Section 1.

The Board does hereby implore the Monroe
County Legislative Delegation to oppose any changes in the
sentencing guidelines or other changes in classification of
crimes, the result of which will allow more categories of
prisoners to be incarcerated in the County jail.
Section 2.
Monroe County further objects to the cost of
shifting the state penal system to the County and, therefore,
Monroe County strongly opposes House Bill 79.
Section 3.
The Clerk of the Board is hereby directed to
forward certified copies of this Resolution to the Monroe County
Legislative Delegation and the Florida Association of Counties.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of the Board held on
the 4th day of March, A.D. 1993.
