RESOLUTION AUTHORIZING THE CHAIRMAN OF THE BOARD OF
COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, TO
EXECUTE SUPPLEMENTAL AGREEMENT NO. 3 TO LEASE
NO. DACA01-1-79-586 EAST MARTELLO BATTERY SITE (KW-
65) BY AND BETWEEN THE SECRETARY OF THE ARMY AND
MONROE COUNTY, FLORIDA, FOR THE PURPOSE OF EXTEND-
ING LEASE NO. DACA01-1-79-586 FOR AN ADDITIONAL TERM
OF ONE YEAR.
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, as follows:
That the Mayor and Chairman of the Board of County
Commissioners of Monroe County, Florida, is hereby authorized to
execute Supplemental Agreement No.3 to Lease No. DACA01-1-79-586
East Martello Battery Site (KW-65) by and between the Secretary
of the Army, and Monroe County, Florida, a copy of same being
attached hereto, for the purpose of extending Lease No.
DACA01-1-79-586 for an additional term of one year.
Passed and adopted by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the 16th day of December, A.D. 1983.

THIS SUPPLEMENTAL AGREEMENT, made between the Secretary of the Army, of
the first Dart, and the Board of County Commissioners, Monroe County, Florida,
of the second part, WITNESSETH:
WHEREAS, on 17 September 1979, by Lease No. DACAOI-I-79-586, the Secretary
of the Army leased to the party of the second part, hereinafter called the lessee,
for a term of five (5) years, beginning 1 January 1977, and ending 31 December 1981,
but revocable at will by the Secretary of the Army, certain property at the East
Marte 11 0 Battery Site (K~J-65), Monroe County, Flori da, as more parti cul arly
descri bed in the sai d 1 ease, for use and occupancy by the ~1onroe County Ci\~il
Defense Board; and
WHEREAS, by Supplemental Agreements Nos. 1 and 2, respectively dated
19 October 1981, and 15 December 1982, the term of the said lease was extended
to 31 December 1983; and
WHEREAS, the entire Department of the Army property known as the East
Martello Battery Site (KW-65) has been identified for transfer to the Department
of the Navy; and
WHEREAS, the lessee has a continuing requirement for the occurancy and use
of the leased property beyond 31 December 1983 and it has been aporopriately
determined that the leased property is available for such continuing occunancy
and use subject to the aforesaid property transfer to the Department of the
Navy; and
WHEREAS, it is mutually agreed and desired by the parties hereto to amend
the said lease to extend the term thereof one year through 31 December 1984,
subject to the transfer to the transfer of the property to the Department of the
Navy.
NOW THEREFORE, effective 31 December 1983, the term of Department of the
Army Lease No. DACAOl-1-79-586, dated 17 September 1979, is hereby extended to
31 December 1984.
Except as herein provided, all other terms and conditions of the said lease
shall remain unchanged.
This supplemental aqreement is not subject to Title 10, United States Code,
Section 2662.' . ..
