RESOLUTION NO. 242 -1983
RESOLUTION KRHBKEXNE/REVERSING THE DECISION
OF THE ZONING BOARD OF MONROE COUNTY,
FLORIDA, WITHOUT PREJUDICE AND APPROVING/
RXNXING THE REQUEST OF MATECU CORPORATION TO
REVERSE THE DECISION OF THE ZONING BOARD OF
MONROE COUNTY, FLORIDA DENYING A DIMENSIONAL
VARIANCE.
WHEREAS, the Zoning Board of Monroe County, Florida, on
May 4, 1983, denied a dimensional variance on the following
described property:
(1) a variance of 5 feet to locate the tennis court
within 25 feet of building "B". (2) a variance of
12 feet to locate the tennis court to within 18 feet of
the property line. (3) a variance of 10 feet to
locate the swimming pool/pump house and pool deck to
within 20 feet of the tennis court and building "A".
(4) a variance of 15 feet to locate the swimming
pool/pump house and pool deck to within 15 feet of the
property line, on a Tract of land located in Government
Lot 1, Section 6, Township 64 South, Range 37 East.
Upper Matecumbe Key. Zoned RU-3.
WHEREAS, Matecu Corporation has duly appealed said decision
to the Board of County Commissioners of Monroe County, Florida,
sitting as the Board of Appeals, and the Board having reviewed
the transcript of the May 4, 1983 hearing, having considered the
argument of all parties present wishing to speak on the matter,
and all premises considered, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, sitting as the BOARD OF APPEALS, as
follows:
1. That the decision of the Zoning Board of Monroe County,
Florida, on May 4, 1983, denying a dimensional variance as
requested by Matecu Corporation be, and the same is hereby
llqUimihd/ rever sed.
2. That the said Matecu Corporation be, and they are hereby
granted/EBEX2R a reversal of the decision of the Zoning Board of
Monroe County, Florida, denying a dimensional variance on the
above described property.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the ~hday of August
