ZONING BOARD OF MONROE COUNTY, FLORIDA, AND GRANTING/
D~G THE REQUPo!S p~ OCEAN HARBOUR DEVELOPMENT
C~PORATION TO A ~7REVERSE THE DECISION OF THE
ZONING BOARD OF ONROE COUNTY, FLORIDA, DENYING
APPROVAL, BASED ON THE 4/STH RULE, FOR A REQUEST
FOR A MAJOR DEVELOPMENT AND FINAL MAJOR DEVELOPMENT
PLAN, COMMUNITY IMPACT STUDY, AND CHANGE OF ZONING
FROM RU-l TO RU-3 FOR TRACTS I, J AND K OF
PLANTATION BEACH SUBDIVISION, AS RECORDED IN PLAT
BOOK 2, PAGE 76, AND LOCATED IN SECTION 18, TOWNSHIP
63 SOUTH, RANGE 37 EAST, PLANTATION KEY, FOR PROJECT
KNOWN AS OCEAN HARBOUR AS REQUESTED BY OCEAN HARBOUR
DEVELOPMENT CORPORATION.
WHEREAS, the Zoning Board of Monroe County, Florida, on
July 29, 1983, denied, based on the 4/Sth rule, the request of
Ocean Harbour Development Corporation for approval of an
application for a Major Development Final Major Development Plan,
Community Impact Study, and Change of Zoning from RU-l to RU-3
for for a Major Development Project known as Ocean Harbour, on
property described as:
Tracts I, J and K of Plantation Beach Subdivision,
as recorded in Plat Book 2, Page 76, and located in
Section 18, Township 63 South, Range 37 East,
Plantation Key,
and
WHEREAS, Ocean Harbour Development Corporation having duly
appealed said decision to the Board of County Commispioners of
Monroe County, Florida, sitting as the Board of Appeals, and the
Board having reviewed the transcript of the July 29, 1983
hearing, having considered the argument of all parties present
wishing to speak on the matter, and all premises considered, now,
therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, sitting as the BOARD OF APPEALS, as
follows:
1. That the decision of the Zoning Board of Monroe County,
Florida, of July 29, 1983, regarding approval of the request of
Ocean Harbour Development Corporation for approval of a Major
Development and Final Development Plan, Community Impact Study,
and Zoning change from RU-l to RU-3 on the above described
property for project ~~s Ocean Harbour be, and the same is
hereby aff~ed/reversed.
2. ~hat Ocean Harbour Development Corporation be and it is
hereby gran~/~d a reversement of the decision of the Zoning
Board of Monroe County, Florida, denying the request of Ocean
Harbour Development Corporation for approval of a Major
Development and Final Development Plan, Community Impact Study,
and Zoning change from RU-l to RU-3 on the above described
property for project known as Ocean Harbour.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the 10th day of November, A.D. 1983.
