RESOLUTION NO. 137 -1983
RESOLUTION UPHOLDING/REVERSING THE BOARD OF ADJUSTMENT
OF MONROE COUNTY, FLORIDA, AND GRANTING/DENYING THE
REQUEST OF JACK R. DYSTRA AND JACK R. DYKSTRA, II,
TO REVERSE THE DECISION OF THE BOARD OF ADJUSTMENT
DENYING A DIMENSIONAL VARIANCE.
WHEREAS, the Board of Adjustment of Monroe County, Florida,
denied the request of Jack R. Dystra and Jack R. Dykstra, II, for
a dimensional variance as described below:
To the minimum lot area requirement for a proposed re-
zoning to RU-3, on a tract of land in part of Gov't
Lot 1 together with a small island or key, known locally
as Coral Key, in the Bay of Florida, just north of Gov't
Lot 1, all being located in Section 9, Township 66 South,
Range 32 East, Marathon. Zoned RU-l.
WHEREAS, Jack R. Dykstra and Jack R. Dykstra, II, having duly
appealed said decision to the Board of County Commissioners of
Monroe County, Florida, sitting as the Board of Appeals, and the
Board having reviewed the transcript of the June 11, 1982, hearing,
having considered the argument of all parties present wishing to
speak on the matter, and all premises considered, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA, sitting as the BOARD OF APPEALS, as follows:
1. That the decision of the Board of Adjustment of Monroe
County, Florida, of June 11, 1982, denying the dimensional variance
for the above described property, for Jack R. Dykstra and Jack R.
Dykstra, II, be, and the same is hereby ~ld/reversed.

2. That the said Jack R. Dykstra .:ind"Jack R. Dykstra, II, be
and they are hereby granted/dn~ed.a reversal of the decision of
the Board of Adjustment of Mo~~county, Florida denying the re-
quested dimensional variance as hereinabove described.
Passed and adopted by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held on
the 29th day of April, A.D. 1983.
