RESOLUTION NO. 138-1983
RESOLUTION UPHOLDING/REVERSING THE DECISION OF THE
ZONING BOARD OF MONROE COUNTY, FLORIDA, WITHOUT
PREJUDICE AND APPROVING/DENYING THE REQUEST OF THE
BIG PINE KEY CIVIC ASSOCIATION, INC., THE LOWER
KEYS CHAPTER OF THE ORGANIZED FISHERMEN OF FLORIDA,
HENRY NAUBEREIT, HENRY STAPLES AND JOE KITE TO
REVERSE THE DECISION OF THE ZONING BOARD OF MONROE
COUNTY, FLORIDA, GRANTING PRELIMINARY APPROVAL OF
A CHANGE OF ZONING FROM GU TO RU-3 AND PRELIMINARY
MAJOR DEVELOPMENT APPROVAL AND COMMUNITY IMPACT
STATEMENT APPROVAL AS REQUESTED BY MARGARET C.
STRAEHLEY.
WHEREAS, the Zoning Board of Monroe County, Florida, on
November 24, 1982, granted preliminary approval of a change of
zoning from GU to RU-3 and preliminary major development approval
and community impact statement approval as requested by Margaret C.
Straehley on the following described property:
A parcel of land in part of Government Lot 1, as located
in Section 6, Township 67 South, Range 30 East, Big Pine
Key, Monroe County, Florida.
and
WHEREAS, the Big Pine Key Civic Association, Inc., the Lower
Keys Chapter of the Organized Fishermen of Florida, Henry Naubereit,
Henry Staples and Joe Kite have duly appealed said decision to the
Board of County Commissioners of Monroe County, Florida, sitting as
the Board of Appeals, and the Board having reviewed the transcript
of the November 24, 1982 hearing, having considered the argument of
all parties present wishing to speak on the matter, and all premises
considered, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA, sitting as the BOARD OF APPEALS, as follows:
1. That the decision of the Zoning Board of Monroe County,
Florida, of November 24, 1982, granting preliminary approval of a
change of zoning from GU to RU-3 conditioned on final hearing on
the above described property, preliminary major development approval
and community impact statement approval as requested by Margaret C.
Straehley be and the same is hereby upheld without prejudice and
the same be remanded to the Zoning Board of Monroe County, Florida
for Final Hearing, and that the appeal period provided in Florida
Statutes Section 61-2503 is hereby tolled.

2. That~~ellaid Big Pine Key Civic Association, Inc., the
Lower Keys Chap~tY of the Organized Fishermen of Florida, Henry
Naubereit, Henry Staples and Joe Kite are hereby gr~ted/denied

without prejudice a reversal of the decision of th~i~ning Board of
Monroe County, Florida, granting pre~iminary approval of a change
of zoning from GU to RU-3 and preliminary major development approval
and community impact statement approval on the above described
property.
Passed and adopted by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held on
the 29th day of April, A.D. 1983.
