RESOLUTION NO. 067 -1983
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS
OF MONROE COUNTY, FLORIDA, REQUESTING THE FLORIDA.
LEGISLATURE. AND THE FLORIDA DEPARTMENT. OF HEALTH
AND REHABILITATIVE SERVIICES TO STUDY AND MODIFY
THE STANDARDS FOR ONSITE SEWAGE DISPOSAL SYSTEMS
NOW IN EFFECT.

WHEREAS , the geography and geology of Monroe County result
in unusual problems in providing for sewage disposal in the County,

WHEREAS , there are no publicly operated sewage disposal systems
in the unincorporated portions of the County, and: all sewage which
is treated is handled either by individual onsite systems, or onsite
systems serving more than on residence or business , and
WHEREAS, all sewage disposa. systems in the County must be
designed, constructed and installed in accordance with regulations
promulgated by the Florida Department of Health and Rehabilitative
Services , as found in Section l6-6 of the Florida Administrative
Code, which were effective on. January 1, 1983, forthe . entire State,

WHEREAS, because of the peculiar and unique circumstances found
in Monroe County, these state-wide regulations serve to substantially .
reduce the opportunities for development, and restrict the exercise
of individual property rights oft I property owners -in the County, now,

therefore,
IT IS HEREBY RESOLVED by the Board of County Commissioners of
Monroe County, Florida, that :
The Board of County Commissioners of Monroe. County, Florida,
requests the Florida Legislature; and the Florida Department of
Health and Rehabilitative Services to re-examine the Standards. for
Onsite Sewage Disposal Systems, found in Florida Administrative
Code Section 10D-6, and in the underlying statutes, in order that
modifications may be made in these statutes and regulations , taking
into consideration the peculiar and unique geography and geology of
the County, to enable property owners in this County to exercise

their property rights and to develop their property, under applicable
State and County building and zo ing regulations, as other property
owners in the State are permitted; to do under applicable State and
County building and zoning regulations, and that Monroe County be
excluded from these rules for Period of one (1) year pending
further study.
PASSED AND ADOPTED by the B9ard of County Commissioners of
Monroe County, Florida, at a regular meeting held on March 4, 1983.
