RESOLUTION NO. 158 -1993
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, DENYING THE APPEAL OF ERNESTO
AND ANA FERNANDEZ AND UPHOLDING THE PLANNING
COMMISSION'S DECISION WHICH UPHELD THE DECISION OF PAT
MCNEESE, DIRECTOR OF ENVIRONMENTAL RESOURCES, IN
DENYING A PERMIT APPLICATION TO CONSTRUCT AN OBSERVA-
TION PLATFORM FOR PROPERTY DESCRIBED AS LOT 18, BLOCK
3, MATECUMBE OCEAN BAY SECTION 1, LOWER MATECUMBE KEY,
MONROE COUNTY, FLORIDA.
WHEREAS, on December 3, 1992, the Planning Commission denied
the administrative appeal of Ernesto and Ana Fernandez (Resolu-
tion No. P45-92, dated January 21, 1993), and upheld the decision
of Pat McNeese, Director of Environmental Resources, in denying a
permit application for an observation platform for property
described as Lot 18, Block 3, Matecumbe Ocean Bay Section 1,
Lower Matecumbe Key, Monroe County, Florida; and
WHEREAS, Ernesto and Ana Fernandez appealed said decision to
the Board of County Commissioners; and
WHEREAS, this Board has heard the argument from both the
Appellant and Respondent and has reviewed the record of the
appeal; now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, as follow:
1. The Board hereby denies the appeal of Ernesto and Ana
Fernandez in that the Fernandez' failed to show an error on the
part of the Planning Commission; and
2. The Board hereby upholds the Planning Commission's
decision of December 3, 1992, (Resolution No. P45-92, dated
January 21, 1993) which upheld the decision of Pat McNeese,
Director of Environmental Resources, in denying a permit
application for an observation platform for property described as
Lot 18, Block 3, Matecumbe Ocean Bay Section 1, Lower Matecumbe
Key, Monroe County, Florida.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the
